         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show his correct date of birth, and his correct unit of assignment while serving overseas. In support of his request the applicant submits copies of his birth certificate and his separation documents.

3. The applicant states that his correct date of birth is 20 December 1924 and not 2 December 1924, and that he was assigned to Company M, 5th Infantry Regiment, not the 57th Infantry Regiment of the 71st Division.

4. The applicant’s military records were lost or destroyed in the National Personnel Records Center fire of 1973. Information herein was obtained from documents submitted by the applicant.

5. The applicant was originally inducted into the Army of the United States on
29 November 1945, and enlisted in the Regular Army on 15 June 1946. He was honorably discharged on 9 June 1947, with a total of 1 year, 6 months and
9 days of creditable service.

6. The applicant’s WD AGO Forms 53-55 and his WD AGO Form 100 shows his date of birth as 2 December 1924.

7. The applicant’s WD AGO Form 100 shows his overseas assignment as Company M, 57th Infantry Regiment, 71st Division.

CONCLUSIONS:

1. The applicant’s birth certificate verifies he was born on 20 December 1924 and not 2 December 1924, and as such his records should be corrected to show his date of birth as 20 December 1924.

2. There are no available records nor did the applicant provide documentation with which to determine any of his unit assignments.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by changing the applicant’s date of birth to read 20 December 1924 instead of 2 December 1924.




2. That so much of the application as is in excess of the foregoing be denied.
