         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests reconsideration of his previous application to correct his military records by awarding him the Purple Heart.

3. The applicant states in effect, that he and three other soldiers were reported as wounded, two of the soldiers were kept at the 23rd Evacuation Hospital and both received the Purple Heart.

4. The Memorandum of Consideration (MOC) (AC88-09898) reflecting the Board’s
27 September 1989 review of the applicant’s request is incorporated herein by reference as if wholly set forth.

5. The applicant submits a letter which outlines his command’s general unit operations, the procedures used during combat conditions and how the injured were treated in the field by medics and/or by hospital personnel.

6. The Awards Branch of the U.S. Total Army Personnel command verified that the applicant’s name was listed on the Vietnam Casualty Roster and/or wounded in action on 5 May 1968.

7. The existence of new evidence requires Board consideration.

CONCLUSIONS:

1. The applicant is entitled to award of the Purple Heart as evidenced by his name on the Vietnam Casualty Roster of 1968 as a battle casualty.

2. Therefore, in view of the foregoing findings and conclusions, correcting the applicant’s records as recommended below would rectify an injustice.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned is entitled to the Purple Heart.
