APPLICANT REQUESTS: That he be awarded a Purple Heart for each time he was injured in Vietnam.
APPLICANT STATES: That he was injured twice while he was in Vietnam in 1968 and his injuries occurred approximately 30 days apart.
EVIDENCE OF RECORD: The applicant's military records show:
He was inducted into the Army on 8 March 1967 at Fort Bliss, Texas. He successfully completed his training as a cannoneer.
On 8 July 1967, he was transferred to Vietnam.
His awards include the National Defense Service Medal, the Vietnam Campaign Medal, the Vietnam Service Medal, two Overseas Service Bars and the Marksmanship Badge (Rifles M-16 and M-14).
On 27 July 1968, he was transferred to the Continental United States and he was honorably released from active duty on 7 March 1969.
A review of the records fails to show that the applicant was ever wounded or injured as a result of hostile action by enemy forces while he was in Vietnam.
Army Regulation 600-8-22 provides, in pertinent part, that the Purple Heart is awarded for a wound/injury sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound/injury was the result of hostile action, the wound/injury must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
2. The Board has noted the applicant’s contentions. However, there is no evidence of record nor has the applicant submitted any evidence to support his contention that he was ever wounded or injured as a result of hostile action by the enemy while he was in Vietnam.
3. In view of the foregoing, there is no basis for granting the applicant's request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.

In accordance with Army Regulation 15-185, the application and the available military records pertinent to the corrective action requested were reviewed to determine whether to authorize a formal hearing, recommend that the records be corrected without a formal hearing, or to deny the application without a formal hearing if it is determined that insufficient relevant evidence has been presented to demonstrate the existence of probable material error or injustice. APPLICANT STATES : In effect, that he was injured in a helicopter accident on 2 December 1967, while serving as a door gunner in the Republic of Vietnam (RVN). It states, in pertinent part, that the PH is authorized to members who are wounded in action. While the applicant has provided evidence, in the form of a summary of his military medical record prepared by the VA, that verifies that he was hospitalized in the RVN for injuries he received in a helicopter accident, he failed to provide...

The Board considered the following evidence: A review of the applicant’s records fails to show any evidence that the applicant was wounded/injured while in Vietnam or that he was treated for an injury or wound. However, the evidence of record does show that he is entitled to be awarded the RVNGC w/Palm Unit Citation and four bronze service stars for wear on his already awarded VSM.

He was a medic so he was able to treat himself. A Clinical Record Radiographic Report dated 27 August 1968 shows the applicant was involved in a mine accident and thrown around a truck. That all of the Department of the Army records related to this case be corrected by awarding the applicant the Purple Heart for wounds received on 27 August 1968 and the Army Good Conduct Medal for the period 28 July 1967 – 25 July 1969.

The applicant requests correction of his military records to show that he was awarded the Purple Heart and that he served in Vietnam for more than one year. There are no orders in the applicant’s service personnel records, which show that he was awarded the Purple Heart. While the Board has no reason to doubt the applicant’s statement that he was in fact wounded and awarded the Purple Heart, documentary evidence is required to correct a military record.
ARMY | BCMR | CY2001 | 2001064776C070421
The applicant states that he was injured on active duty when his shoulder was dislocated while engaged with the enemy snipers in Vietnam. The evidence of record fails to clearly show that the applicant was wounded/injured as a result of enemy action, in fact, the evidence shows that he initially injured himself during his infantry training and that his surgery was the result of recurring dislocations. In view of the foregoing, the applicant’s records should be corrected as recommended below.

EVIDENCE OF RECORD : The applicant's military records show: This document does not indicate how the applicant received these fragment wounds or what official military medical record documentation was used to support this finding. It also specifically states that in order to support awarding a member the PH, it is necessary to establish that the wound, for which the award is being made, required treatment by a medical officer.

The applicant requests, in effect, that his records be corrected to show that he was discharged in the pay grade of E-5 instead of E-4, and that he was awarded two Purple Hearts and the Army Commendation Medal. He also requests corrections be made to his service medical records. The applicant’s medical records do not appear to be in error.
