         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his records be corrected to show that he was awarded a "Presidential Citation" (not further identified).

3. The applicant states, in effect, that his unit - Battery B, 424th Field Artillery Battalion - fired a mission in February 1951 that was highly successful. His commander told all of the unit personnel that he was recommending them for a Presidential Unit Citation. He states that he never received this award.

4. The applicant's military records were lost or destroyed in the National Personnel Records Center fire of 1973. Information herein was obtained from alternate sources. It shows that he was inducted into the Army of the United States on 14 November 1950 and served in military occupational specialty (MOS) 3844 (Artillery). His most significant duty assignment was with Battery B, 424th Field Artillery Battalion in Korea. The exact dates of his foreign service are unknown; however, he served overseas for 11 months and 26 days. He was honorably discharged on 18 November 1952.

5. Army Regulation 600-8-22 (Military Awards) provides, in pertinent part, that the Presidential Unit Citation (known as the Distinguished Unit Citation until 3 November 1966) is awarded to a unit for extraordinary heroism in action. A unit must display such gallantry, determination and esprit de corps in accomplishing its mission as would warrant award of the Distinguished Service Cross to an individual. Department of the Army Pamphlet (DA PAM) 672-1 (Unit Citation and Campaign Participation Credit Register) indicates that only Battery A, 424th Field Artillery Battalion was cited for award of the Distinguished Unit Citation for action in Korea on 13 July 1953.

6. DA PAM 672-1 reflects that the applicant's unit was awarded the Republic of Korea Presidential Unit Citation by Department of the Army General Order 41-55, for service in Korea during the period 19 September 1950 through 31 July 1952.

CONCLUSIONS:

1. The applicant is not entitled to the Presidential Unit Citation (formerly the Distinguished Unit Citation). DA PAM 672-1 does not authorize that award for his unit.

2. The applicant's unit was awarded the Republic of Korea Presidential Unit Citation for service during the period of his assignment to the unit. He is entitled to this award.

3. In view of the foregoing, the applicant’s records should be corrected, but only as recommended below.


RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by issuing to the individual concerned a DD Form 215 (Correction to DD Form 214) showing that he was awarded the Republic of Korea Presidential Unit Citation.

2. That so much of the application as is in excess of the foregoing be denied.
