         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests, in effect, correction of her date of reenlistment in the Army Reserve (USAR) and award of the Student Loan Repayment Program (SLRP).

3. The applicant states that she reenlisted in the USAR on 7 November 1998 vice 6 November 1998. She indicates that through an administrative error, her reenlistment contract had the dates of 6 and 7 November 1998; therefore, she has been denied the SLRP for which she reenlisted.

4. The applicant’s military records show that on 26 October 1992, she enlisted in the USAR for 8 years in pay grade E-3. During the period 5 March to 9 July 1993, she completed 4 months and 5 days of active duty for training. She completed her required training and was awarded military occupational specialty 73C (Accounting Specialist).

5. On 7 November 1998, she reenlisted for 6 years, in pay grade E-5, for the SLRP. At this time, she had completed 6 years and 10 days of total service, which ended on 6 November 1998, the day preceeding her reenlistment.

6. On 1 November 2000, officials at the SLRP headquarters, Fort McCoy, Wisconsin advised the applicant’s commander that the reenlistment document was incorrect but would be honored upon correction of the conflicting dates.

7. On 31 January 2001, officials at the SLRP headquarters advised the applicant’s commander that the correction of the reenlistment document would have to be made by this Board.

CONCLUSIONS:

1. The evidence of record shows the applicant completed a total of 6 years and 10 days of combined active and inactive service on 6 November 1998 and reenlisted the following day, 7 November 1998.

2. The applicant’s reenlistment document erroneously shows a mechanical date of reenlistment as “19981106” while the handwritten date by the applicant and the Retention NCO is “7 November 1998”. Her records should be corrected accordingly.

3. The applicant’s SLRP was properly denied based on conflicting dates on the reenlistment document, however, correction of the reenlistment date will alleviate this problem.

4. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was reenlisted on 7 November 1998.
