         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his Report of Transfer or Discharge, DD Form 214, be corrected to add the Purple Heart and the Army Commendation Medal.

3. The applicant states that he has both of these medals but they are not listed on his DD Form 214.

4. The applicant’s military records show that he was inducted into the Army on 19 March 1968. He completed basic combat training and advanced individual training and was awarded military occupational specialty 11B (Light Weapons Infantryman).

5. The applicant arrived in Vietnam on or about 3 October 1968 and was assigned to Company C, 2d Battalion, 60th Infantry, 9th Infantry Division as a rifleman and senior rifleman. His Enlisted Qualification Record, DA Form 20, shows that he was wounded on 5 February 1969 by fragmentation wounds in the left arm, left leg, and back. He was assigned to a medical holding detachment on 8 February 1969. He was transferred to Korea on 20 February 1969. General Orders 2025, Headquarters, 9th Infantry Division dated 20 February 1969 awarded him the Army Commendation Medal. There is no evidence to show Purple Heart orders were issued. He was released from active duty on 21 October 1969.

6. Army Regulation 600-8-22 provides policy and criteria concerning individual military decorations. In pertinent part, it states that the Purple Heart is awarded to any member of an Armed Force who has been wounded or killed in any action against an enemy of the United States. The wound must have required treatment by a medical officer and records of medical treatment for wounds or injuries received in action must have been made a matter of official record.

7. Department of the Army Pamphlet 672-3 shows that the 2d Battalion, 60th Infantry was awarded the Republic of Vietnam Gallantry Cross with Palm for the period January – June 1969 and the Republic of Vietnam Civil Actions Honor Medal, First Class for the period 19 December 1966 – 28 June 1969.

CONCLUSIONS:

1. The evidence of record shows that the applicant was wounded in action on 5 February 1969 and that he was awarded the Army Commendation Medal. In addition, because he was assigned to a unit during a period of time that unit was awarded the Republic of Vietnam Gallantry Cross with Palm and the Republic of Vietnam Civil Actions Honor Medal, First Class, he is entitled to award of those medals, also.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.
RECOMMENDATION:

1. That all of the Department of the Army records related to this case be corrected by showing that the applicant was awarded the Purple Heart for wounds received in action on 5 February 1969.

2. That the applicant’s DD Form 214 be amended to add the Purple Heart, the Army Commendation Medal, the Republic of Vietnam Gallantry Cross with Palm, and the Republic of Vietnam Civil Actions Honor Medal, First Class.
