         The applicant and counsel if any, did not appear before the Board.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military
records
         Exhibit B - Military Personnel Records (including
         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that Block 12a (date entered active duty this period) of his DD Form 214, Certificate of Release or Discharge from Active Duty, issued on 14 November 1979, be corrected to 15 November 1977.

3. The applicant states, in effect, that the date in Block 12a of his DD Form 214 is incorrect.

4. In support of his application, the applicant submitted: a copy of his DD Form 214; Active Duty Orders; DA Form 1506, Statement of Service; DA Form 2-1, Personnel Qualification Record; and The Army Reserve Personnel Command (ARPC) Chronological Statement of Retirement Points, ARPC Form 249-2-E.

5. The applicant’s military records show that he was ordered to active duty on 15 November 1977 for a period of 730 days.

6. DA Form 1506 reflects that the applicant was ordered to active duty for special active duty work for a period of 2 years from 15 November 1977 to 14 November 1979.

7. DA Form 2-1, Section VII, Current and Previous Assignments reflects that, on 15 November 1977, the applicant was ordered to active duty for a 2-year statutory tour as a recruiter.

8. DD Form 214 shows the applicant was released from active duty on 14 November 1979 and transferred to the 318th Regiment, Charlottesville, Virginia. He was separated under the provisions of paragraph 5-3, Army Regulation 635-200 (Determination of Service Secretary). He was credited with 2 years of active military service

CONCLUSIONS:

1. The entry in Block 12a of his DD Form 214 is incorrect and should be corrected to show the proper date, 15 November 1977.

2. In view of the foregoing, the applicant’s records should be corrected as recommended below.


RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by issuing to the individual concerned a DD Form 215, Correction to DD Form 214, which shows Block 12a of his 14 November 1979 DD Form 214 is corrected to read "77 11 15."
