         I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. The following members, a quorum, were present:

         The applicant and counsel if any, did not appear before the Board.

         The applicant requests correction of military records as stated in the application to the Board and as restated herein.

         The Board considered the following evidence:

         Exhibit A - Application for correction of military

         advisory opinion, if any)

FINDINGS :

1. The applicant has exhausted or the Board has waived the requirement for exhaustion of all administrative remedies afforded by existing law or regulations.


2. The applicant requests that his separation document (DD Form 214) be corrected to reflect all of his authorized awards and decorations as well as the schools he attended.

3. The applicant states, in effect, that he was not at his home station at the time he separated and because he was separated on temporary records, his DD Form 214 dated 4 December 1991 did not contain all of the pertinent information pertaining to his service.

4. The applicant’s military records show that he enlisted on 28 June 1988 for a period of 4 years. He was promoted to the pay grade of E-4 on 1 October 1990 and continued to serve until he was honorably released from active duty on 4 December 1991 under the provisions of Army Regulation 635-200 and the Fiscal Year 1992 Early Transition Program. He had served 3 years, 5 months, and 7 days of total active service.

5. The applicant’s DD Form 214 shows that he was separated on temporary records and that all missing information would be corrected by the issuance of a DD Form 215. There is no evidence to show that a DD Form 215 was ever issued.

6. A review of the applicant’s records, when compared to his DD Form 214, shows that his date of rank (911001) is missing from item h and that his foreign service (2 years) in Germany as an armor crewman is also missing in item 12f. In addition, the applicant’s records should show in item 13, that he was awarded the Army Achievement Medal with two oak leaf clusters (AAM 2OLC) and in item 14, that he attended the Headstart course for a period of 1 week in 1988.

CONCLUSIONS:

1. The applicant was separated without the benefit of having his permanent military records present at the time of his separation which resulted in absence of information being placed on his DD Form 214 at that time.

2. Although the DD Form 214 indicates that a DD Form 215 would be prepared to reflect the information that was unavailable at the time of separation, it appears that an administrative oversight resulted in the corrections not being made to the applicant’s DD Form 214. Therefore, it would be appropriate to make the changes at this time.

3. While it is noted that the applicant attended other military courses which are combat arms related, they are not authorized for entry on the DD Form 214.

4. In view of the foregoing, it would be appropriate to correct the applicant’s records as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected:

a. by showing that individual concerned served 2 years of foreign service in Germany, that his date of rank was 1 October 1990; and

b. that he was awarded the AAM 2OLC and attended the Headstart course for a period of 1 week in 1988.
