2. In effect, the applicant requests that his DD Form 214 (Certificate of Release or Discharge from Active Duty) show his rank and pay grade as PV2 E-2, vice PV1 E-1.
3. He states that his pay grade was E-2 when he was discharged for medical reasons.
4. The applicant enlisted in the Army Reserve on
27 April 1985 and entered on active duty for basic training on 3 June 1985. He completed that training and was released from active duty and transferred to his Reserve unit on
2 August 1985. He was advanced to pay grade E-2 on
3 December 1985.
5. The applicant entered active duty for advanced individual training on 24 March 1986 and was discharged on 11 April 1986 because of a physical disability prior to his entry on active duty, under the provisions of Army Regulation 635-40, chapter 5. His DD Form 214 shows his rank and pay grade as PV1 E-1.
6. Army Regulation 140-158, then in effect, prescribes policies and procedures pertaining to the promotion of enlisted members of the U.S. Army Reserve. Paragraph 4-14 of that regulation states that a soldier will be advanced to grade E-2 when he completes 6 months of service from the date of entry on IADT (initial active duty for training).
CONCLUSIONS:
1. The applicant was advanced to pay grade E-2 on
3 December 1985 in accordance with the provisions of the regulation in effect at that time.
2. The applicants DD Form 214 should reflect his rank and pay grade as PV2 E-2.
3. The applicant should receive all pay and allowances due.
4. In view of the foregoing findings and conclusions, it would be appropriate to correct the applicants records as recommended below.
RECOMMENDATION:
That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was advanced to pay grade E-2 on 3 December 1985, that his DD Form 214 reflect his rank and pay grade as PV2 E-2, and that he receive all pay and allowances due.
