APPLICANT REQUESTS: That his DD Form 214, Report of Separation, be corrected to show that he was awarded the Purple Heart.
APPLICANT STATES: That the Purple Heart was awarded to him for wounds suffered in Vietnam. In support of his request, he provides a copy of a Purple Heart Certificate dated 12 May 1969 identifying him as the recipient. He also requests that the name of the unit on the certificate be corrected.
EVIDENCE OF RECORD: The applicant's military records show:
He enlisted for 3 years on 23 October 1966 and served 2 years, 3 months and 11 days in Vietnam. On 6 July 1969 he was honorably released from active duty and transferred to the USAR to complete his military service obligation.
Despite the Purple Heart Certificate included with his application, there is no other evidence in the available records to substantiate that he was wounded or injured as a result of hostile action or otherwise entitled to the Purple Heart. The enlisted qualification record contains no entries for wounds received, nor does the record of assignments section indicate he was hospitalized during his service, and the awards and decorations section does not show the Purple Heart as an authorized award.
On 25 September 1996 the applicant was requested to furnish the original Purple Heart Certificate or a certified copy thereof; however, he has not responded to the request.
Army Regulation 600-8-22, Military Awards, provides in pertinent part, that the Purple Heart is awarded for a wound sustained as the result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, it is concluded:
1. After examining all of the records, there is no evidence that the applicant was wounded or injured as the result of enemy action. Additionally, in the absence of substantiating evidence elsewhere in the record that he was awarded a Purple Heart, the Purple Heart Certificate by-itself does not provide the compelling evidence necessary to grant the relief requested.
2. In order to justify correction of a military record, the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust. The applicant has failed to submit evidence that would satisfy this requirement.
3. In view of the foregoing, there appears to be no basis for granting the applicants request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.

He did not think his wound merited the Purple Heart at the time of his injury. His DA Form 20 (Enlisted Qualification Record) and DA Form 2-1 (Personnel Qualification Record) show he was assigned to Vietnam from 1 July 1966 to 1 July 1967. There is no evidence that shows he was injured or wounded as a result of hostile action or that he was awarded the Purple Heart.

There is no evidence of record that shows he was injured or wounded as a result of hostile action or that he was awarded the Purple Heart. Army Regulation 600-8-22 (Military Awards) states the Purple Heart is awarded for a wound sustained while in action against and enemy or as a result of hostile action. The applicant contends he should be awarded the Purple Heart because he was injured while serving in Vietnam.

The applicant requests a second award of the Purple Heart. An EOD Activities Report, dated 27 July 1969, for the period 1 January through 30 June 1969, which lists the applicant as having received lacerations while recovering a damaged 2.75" rocket on 28 April 1969. However, by regulation, in order to support award of a second Purple Heart there must be evidence confirming the wound/injury for which the award is being made was received as a direct result of or was caused by enemy action,...

The documentation provided by the applicant is new evidence that will be considered by the Board. Army Regulation 600-8-22 (Military Awards) states the Purple Heart is awarded for a wound sustained in action against an enemy or as a result of hostile action. The Purple Heart requires: * a wound was the result of hostile action * treatment of the wound by military medical personnel * documentation of the wound in official records * official orders awarding the decoration 3.

Application for correction of military records (with supporting documents provided, if any). Item 41 (Awards and Decorations) of his DA Form 20 does not list the Purple Heart among his awards. Therefore, in the absence of additional documentation that conclusively shows he was wounded or injured as a result of enemy action and treated for those wounds there is insufficient evidence to show he was awarded the Purple Heart.

The applicant states a letter from the National Personnel Records Center (NPRC), dated 10 May 2006, verifies his entitlement to the Purple Heart. The FSM's records are void of orders awarding the Purple Heart or any other evidence showing he sustained an injury as a result of hostile action. Notwithstanding her sincerity, in the absence of documentation that conclusively shows the FSM was wounded or injured as a result of hostile action, treated for those wounds/injuries, and his treatment...

The applicant's service record is void of any orders that show he was awarded the Purple Heart or that he was wounded or injured as a result of combat. The VA letter he provides states that he was awarded service-connected disability compensation for a scar to the left chest; however, this document does not prove he suffered a combat injury as a result of hostile action or that he required or received treatment for it. Notwithstanding the applicant's contention and sincerity, in the...
