2. The applicant requests correction of his military records to show that he was eligible for incentive special pay (ISP) for the period July 1994 through October 1995. He states that he completed his medical board certification in July 1994.
3. The applicant is currently serving on active duty in the Medical Corps with the rank of captain.
4. The Department of Defense Military Pay and Entitlements manual provides that medical officers may be authorized ISP under certain criteria. To be eligible for ISP a medical officer must sign an agreement to remain on active duty for at least 1 additional year. The ISP is paid in a lump sum at the beginning of the 12-month period for which the officer is entitled to such pay. Entitlement to special pay is in addition to any other pay and allowances.
5. Department of the Army (DA) Message Number 161505Z, states in pertinent part, that officers graduating from initial residency or initially qualifying for ISP during the ongoing fiscal year will become eligible for entitlement to ISP effective 1 October of the following year.
6. In the processing of this case, a staff advisory opinion was obtained from the Office of the Surgeon General (OTSG) which advised that the applicant was eligible for ISP for the period 1 October 1994-30 September 1995 at the rate of $3,000. He did enter into an ISP agreement for the period
1 October 1995-30 September 1996.
CONCLUSIONS:
1. Although the applicant initially became eligible for the receipt of ISP in July 1994, he was not authorized to enter into an ISP agreement until 1 October 1994 in accordance with the cited DA message.
2. The applicant was eligible to enter into an ISP agreement on 1 October 1994 at the annual rate of $3,000 on

3. In consideration of the foregoing findings and conclusions, it would be appropriate to correct the records as recommended by the OTSG.
RECOMMENDATION:
1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned entered into an ISP agreement for the period
1 October 1994 to 30 September 1995 at the rate of $3,000.
2. That so much of the application as is in excess of the foregoing be denied.
