THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

1.  Application for correction of military records (with supporting documents provided, if any).

2.  Military Personnel Records and advisory opinions (if any).


THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE:

1.  The applicant requests payment of $3,000, which is the additional Incentive Special Pay (ISP) he should have received for the period 1 July 2014 to 30 June 2015.

2.  The applicant states, in effect:

* he is a U.S. Army physician specializing in Neonatology
* he receives ISP annually
* his 1 July 2014 contract incorrectly showed his ISP incentive was $20,000 when it should have been $23,000
* he completed his Neonatology fellowship training in June 2011 and he has been eligible for ISP in the amount of $23,000 since that time

3.  The applicant provides:

* memorandum, dated 18 May 2014, for The Surgeon General (TSG) of the Army, Army Medical Department, subject:  Request for Medical Corps ISP, signed by the applicant
* email dated between 24 and 27 April 2015 that was written between him and representatives at the Office of The Surgeon General (OTSG) and U.S. Army Medical Command
* certificate showing his successful completion of Fellowship Training in Neonatal-Perinatal Medicine during the period 1 July 2008 to 30 June 2011

CONSIDERATION OF EVIDENCE:

1.  The applicant enlisted in the U.S. Army Reserve (USAR) on 2 September 1992 as a cadet.  He was commissioned in the USAR as a second lieutenant in the Armor Corps and executed his oath of office on 25 May 1996.  He later requested a branch transfer to the Medical Service Corps and executed his oath of office on 8 August 1999.  

2.  On 17 May 2003, he graduated from the Armed Services University of the Health Sciences with the degree of Doctor of Medicine.  He executed his oath of office as a Regular Army Medical Corps officer on that same date.

3.  He was accepted for Army Graduate Medical Education wherein he was to receive training in Neonatology beginning 1 July 2008.  

4.  His official military personnel file (OMPF) contains a certificate, U.S. Army Medical Department, showing the applicant successfully completed Fellowship Training in Neonatal-Perinatal Medicine at the Walter Reed Army Medical Center/National Naval Medical Center during the period 1 July 2008 to 30 June 2011.

5.  His OMPF also contains a memorandum, signed by the applicant on 18 May 2014, subject:  Request for Medical Corps ISP, wherein the applicant requested ISP.  In paragraph 2b he states his medical specialty is pediatrics.  In paragraph 4, it states the amount to be received was $20,000.

6.  An advisory opinion, dated 4 June 2015, was provided by the Department of the Army OTSG.  

	a.  A review of special pay and finance records indicate the applicant executed and received annual ISP at the rate of $23,000 effective 1 July 2011 and subsequently on 1 July 2012 and 1 July 2013.  He has been eligible for ISP at the rate of $23,000 since 1 July 2011 and it appears he did not notice his rate and specialty were incorrect when he completed his contract for 2014.

	b.  The applicant is eligible for the 1-year ISP contract at the rate of $23,000 effective 1 July 2014 as a Neonatologist.  He thus is eligible to receive the additional $3,000 he requested.

7.  A copy of the advisory opinion was provided to the applicant on 15 June 2015 and he did not respond.


DISCUSSION AND CONCLUSIONS:

1.  The applicant requests an additional $3,000 of ISP, which is the difference between the amount of ISP he received and the ISP he should have received as a qualified Neonatologist.

2.  In an advisory opinion, the OTSG stated the applicant has been eligible for annual ISP in the amount of $23,000 since 1 July 2011 and he received that amount in 2011, 2012, and 2013.  It appeared the applicant did not notice his rate and specialty were incorrectly entered on his 2014 contract.  He is eligible for the higher ISP rate of $23,000.

3.  The evidence is sufficient to support his request.  As such, he should be paid the $3,000 difference in ISP.

BOARD DETERMINATION/RECOMMENDATION:

1.  The Board determined that the evidence presented was sufficient to warrant a recommendation for relief.  As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his ISP contract that was signed on 18 May 2014 to show in paragraph 2b the specialty of Neonatology.  Also, in paragraph 4, the amount should be corrected to show $23,000.










2.  The applicant should submit a request for the additional $3,000 of ISP to his servicing Finance Office along with a copy of the Board's decision.
