APPLICANT REQUESTS: In effect, that his records be corrected to show that he was not nonselected twice for promotion to Lieutenant Colonel (LTC).
APPLICANT STATES: That his promotion to Major was on 6 September 1989 not 2 September 1987 therefore, his promotion packet should not have
gone to the LTC board until 1995.
EVIDENCE OF RECORD: The applicant's military records show:
On 4 January 1976, the applicant entered active duty and obtained the rank of Captain.
On 1 September 1987, he was relieved from active duty with an Honorable Discharge for failure of selection for permanent promotion.
On 2 September 1987, he was assigned to the U.S. Army Reserve and given a promotion eligibility date (PED) based on his prior commissioned service.
On 6 September 1989, he was selected for promotion by the 1989 Major Reserve Promotion Board and promoted with a date of rank of
22 December 1987, based on 12 years commissioned service, and an effective date of 6 September 1989, the date he was eligible for pay in the higher grade.
Based on the applicants 7 years time in grade, his PED for lieutenant colonel is 23 December 1994. This PED placed him in the zone of consideration for the 1993 and 1994 LTC Reserve Selection Boards.
On 17 April 1996, the U.S. Total Army Personnel Command (ARPERCEN) provided an opinion recommending that the applicants request be denied.
DISCUSSION: Considering all the evidence, allegations, and information presented by the applicant, together with the evidence of record, applicable law and regulations, and advisory opinion(s), it is concluded:
1. In order to justify correction of a military record the applicant must show to the satisfaction of the Board, or it must otherwise satisfactorily appear, that the record is in error or unjust.
2. The applicant has failed to submit evidence that would satisfy the aforementioned requirement.
3. The applicant was correctly considered for promotion by the 1993 and 1994 DA Reserve Component Selection Boards to Lieutenant Colonel.
4. In view of the foregoing, there is no basis for granting the applicants request.
DETERMINATION: The applicant has failed to submit sufficient relevant evidence to demonstrate the existence of probable error or injustice.
