2. The applicant requests correction of his WD AGO Form 53-55, Report of Separation, to reflect that he was awarded the Bronze Star Medal (BSM), the Combat Infantryman Badge (CIB) and the Purple Heart. In support of his request he provides a copy of orders published by the US Army Records Center on 22 September 1959 awarding him the BSM with 1st oak leaf cluster and the CIB.

3. He states that he should receive these awards for his participation in World War II. He contends that he was wounded in Belgium around Christmas time 1944 during the Battle of the Bulge. In support of the Purple Heart request, he provides a statement from a former medical aidman who was involved in the treatment of his injuries at the time.

4. Army Regulation 600-8-22, Military Awards, provides, in pertinent part, that the Purple Heart is awarded for a wound sustained as a result of hostile action. Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.

CONCLUSIONS:

1. Documentary evidence of record shows that the applicant had previously been authorized the BSM and the CIB.

2. While there is no evidence in his record to show that he was awarded a Purple Heart, the witness statement provided by a former medical aidman who assisted in his treatment, seems to authenticate his contention that he was wounded in action and is entitled to the Purple Heart.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing the individual concerned was awarded the BSM, the CIB and the Purple Heart for actions in combat during World War II.

BOARD VOTE:

                       GRANT AS STATED IN RECOMMENDATION

There is no evidence in the available records to show that he was awarded the Purple Heart and his WD AGO Form 53-55 indicates in item 34, that he had no wounds received in action. Army Regulation 600-8-22 provides, in pertinent part, that the Purple Heart is awarded for wounds sustained as a result of hostile action. Accordingly, it would be in the interest of justice to correct his records at this time by awarding him the WWII Victory Medal.

The POW Medal is to be issued only to those U.S. military personnel and other personnel granted creditable U.S. military service who were taken prisoner and held captive while engaged in an action against an enemy of the United States. While there is insufficient evidence on which to base award of the Purple Heart, there is evidence to show the applicant met the eligibility criteria for award of the BSM based upon award of the CIB and for award of the POW Medal. Evidence shows that the...

The awards regulation also provides that subsequent to the cessation of hostilities during World War II, the regulation governing the award of the BSM was changed, in part, to provide for the award of this decoration to those individuals who had been awarded the Combat Infantryman Badge or the Combat Medical Badge for meritorious achievement in ground combat against the armed enemy between 7 December 1941 and 2 September 1945. The record shows that the applicant was a battle casualty and...

I certify that hereinafter is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in the case of the above-named individual. His WD AGO Form 53-55 also lists the Purple Heart as one of his decorations; however, it also includes a “NO RECORD” entry which indicates that there was no record of the applicant being entitled to the award prior to his discharge. Although his WD AGO Form 53-55 indicates that, at the time of his discharge,...
