2.  The applicant requests that his WD AGO Form 53-55, Enlisted Record and Report of Separation, be corrected to reflect that he was awarded the Purple Heart.

3.  He states, in effect, that he was wounded in 1945 and issued the Purple Heart while in the hospital but the award is not shown on his discharge.

4.  His records show that he served in the European Theater of Operation for 1 year and 1 day between 17 September 1944 and 5 September 1945.  He was honorably discharged upon demobilization on 5 November 1945.

5.  His awards include the European-African-Middle Eastern Service Medal, the Good Conduct Medal and the Combat Infantryman Badge (CIB).  His WD AGO 53-55 does not indicate that he suffered any wound during his service.  However, the record contains medical evidence that on 25 June 1945, he was wounded in action near Betzdorf, Germany and treated for a bilateral rupture of the tympanic membrane due to the blast from German ammunition.  His injuries and treatment were recorded on Medical Department Form 52b.  He was returned to duty on 1 July 1945.

6.  Army Regulation 600-8-22, Military Awards, provides, in pertinent part, that the Purple Heart is awarded for a wound sustained as a result of hostile action.  Substantiating evidence must be provided to verify that the wound was the result of hostile action, the wound must have required treatment by a medical officer, and the medical treatment must have been made a matter of official record.

7.  Subsequent to the cessation of hostilities during World War II, the regulation governing the award of the Bronze Star Medal (BSM) was changed, in part, to provide for the award of this decoration to those individuals who had been awarded the CIB or the Combat Medical Badge for meritorious achievement in ground combat against the armed enemy between 7 December 1941 and 2 September 1945.





CONCLUSIONS:

1.  Based on documentary evidence in his file, the applicant should have been awarded the Purple Heart for combat related injuries suffered near Betzdorf, Germany on 25 June 1945.

2.  He should also be awarded the BSM based upon the fact that he was awarded the CIB during the period authorized by regulation for such awards.

3.  In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION:

That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was awarded the Purple Heart for injuries suffered in Germany on 25 June 1945 and the BSM, based on award of the CIB, for meritorious achievement in World War II.
