2. The applicant requests, in effect, correction of his military records to show on his DD Form 214 (Certificate of Release from Active Duty) that he was on active duty from 18 March through 10 November 1993, and that his primary specialty was 91J10 (Physical Therapy Specialist).
3. The applicant enlisted in the U.S. Army Reserve (USAR), in pay grade E-3, for 8 years on 8 August 1991 for training in military occupational specialty (MOS) 91J. A Personnel Qualification Record, dated 11 October 1991, indicates that his MOS was 91J00, and that he was awaiting initial active duty for training (IADT).
4. Orders, dated 6 December 1991, indicate that he was ordered to IADT on 9 January 1992 for basic training under the alternate (split) training program for MOS 91J.
5. A DD Form 220 (Active Duty Report), dated 12 March 1992, indicates that the applicants tour of duty terminated on 13 March 1992.
6. Orders, dated 30 September 1992, indicate that he was ordered to IADT on 18 March 1993 for advanced individual training (AIT) for approximately 31 weeks or completion of MOS training in MOS 91J10.
7. A Personnel Action, dated 9 July 1993, indicates that he was advanced to pay grade E-4 effective 1 July 1993, and that his primary MOS was 91J.
8. Orders, dated 15 July 1993, indicate that the applicant was relieved from attachment at Fort Sam Houston, Texas, effective 30 August 1993, and attached to William Beaumont Army Medical Center for Phase II, Class #002, for training in MOS 91J10.
9. A DA Form 2-1 (Personnel Qualification Record-Part II) indicates that the applicant attended and completed basic training during the period 9 January through 13 March 1992; that he attended and completed AIT during the period 18 March through 10 November 1993; and that his MOS was 91J10.
10. The applicants DD Form 214 shows that the date entered active duty this period was 9 January 1992; that the separation date this period was 10 November 1993; that the net active service this period was 1 year, 10 months, and 2 days; that no entry was made for the total prior active service; that the total prior inactive service was 5 months and 1 day; and that his primary specialty was 91D10 (Operating Room Specialist).
11. Army Regulation 635-5 prescribes the separation documents which are prepared for individuals upon retirement, discharge, or release from active military service or control of the Army. It provides, in pertinent part, that a DD Form 214 will be prepared for members of the USAR after completing 90 days or more of continuous active duty for training, full-time training duty, or active duty support; and after completing IADT which resulted in the award of an MOS even though the active duty was less than 90 days. This includes completion of AIT under the USAR Split Training Program. Paragraph 2-13 provides that
DD Forms 220 will be completed upon completion of the basic training portion for members enlisted under the USAR Split Training Program.
CONCLUSIONS:
1. The evidence of record indicates that the applicant was ordered to IADT and completed basic training during the period 9 January through 13 March 1992; that a DD Form 220 was completed upon his completion of basic training; and that he was ordered to IADT and completed AIT during the period 18 March through 10 November 1993.
2. In view of the foregoing, his DD Form 214 incorrectly shows 9 January 1992 in item 12a (Date Entered Active Duty This Period) since the date was actually 18 March 1993.
3. As a result of the foregoing change to the date entered active duty this period, item 12c (Net Active Service This Period) should be changed to 0 years, 7 months, and 23 days; item 12d (Total Prior Active Service) should be changed to
0 years, 2 months, and 5 days; and item 12e (Total Prior Inactive Service) should be changed to 1 year, 5 months, and 5 days.
4. Since the applicant enlisted for training in MOS 91J and the available documentation shows that he completed that training, it appears that an error was made by Departmental personnel on his DD Form 214 for the period ending on 10 November 1993 by showing his primary specialty as 91D10.
5. In view of the foregoing, it would be appropriate to correct the applicants military records as recommended below.
RECOMMENDATION:
That all of the Department of the Army records related to this case be corrected:
a. by showing in item 11 on the DD Form 214 for the period ending on 10 November 1993 of the individual concerned that his primary specialty was 91J10 (Physical Therapy Specialist);
b. by showing in item 12a on the DD Form 214 for the period ending on 10 November 1993 that he entered active duty this period on 18 March 1993;
c. by showing in item 12c on the DD Form 214 for the period ending on 10 November 1993 that he completed 0 years, 7 months, and 23 days net active service this period;
d. by showing in item 12d on the DD Form 214 for the period ending on 10 November 1993 that he completed 0 years, 2 months, and 5 days total prior active service; and
e. by showing in item 12e on the DD Form 214 for the period ending on 10 November 1993 that he completed 1 year, 5 months, and 5 days total prior inactive service.
