2. The applicant requests that his records be corrected to show that he was entitled to Special Duty Assignment Pay (SDAP) for recruiting duties he performed from 24 March 1987 to 26 April 1988.

3. He states that although he was supposedly suspended from recruiting duties, he was assigned and performed duties as an assistant operations noncommissioned officer (NCO) during that time. In actuality, he claims that he had not been suspended from recruiting duties and, therefore, should be entitled to SDAP for the period in question.

4. The applicant’s military records show that he enlisted in the Regular Army on 11 August 1975, served continuously as an automatic rifleman, personnel carrier driver, team leader, utilities equipment repairer, heat ventilation specialist, recruiter, recruiting station commander, recruiter training NCO, and recruiter assistant operations NCO, and was promoted to pay grade E-7. During the period in question, 24 March 1987 through 26 April 1988, he served as a recruiter training NCO and recruiter assistant operations NCO. He was honorably released from active duty on 26 April 1988 by reason of reduction in authorized strength, fiscal year 1988 early transition program.

5. In the processing of this case an advisory opinion was obtained from United States Army Recruiting Command (USAREC). The USAREC stated that if the applicant was performing duties as a recruiter or as an assistant operations NCO, he would be eligible for SDAP as a staff recruiter with more than 12 months experience at the SD-3 level.

CONCLUSIONS :

1. The applicant’s records do not show that he was ever relieved from his assignment as a recruiter or as a assistant operations NCO, both positions which warrant SDAP.

2. In the absence of any record of the applicant being relieved from performing the duties associated with his duty positions, he is entitled to SDAP for the period in question.

3. In view of the foregoing, the applicant’s records should be corrected as recommended below.

RECOMMENDATION :

1. That all of the Department of the Army records related to this case be corrected by showing that the individual concerned was eligible for SDAP as the SD-3 level from 24 March 1987 to 26 April 1988.

2. That he be paid the SDAP for the period for which approved.
