FD-2013-00754

GENERAL:         The applicant appeals for upgrade of discharge to honorable, to change the reason and authority for the discharge, and to change the reenlistment code.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING: The Board denies the upgrade of the discharge, change of reason and authority for discharge, and change of reenlistment code.

ISSUE: Applicant received a General discharge for Misconduct: Minor Disciplinary Infractions

Applicant contends his discharge was inequitable because his commander and first sergeant did not refer him for an assessment by the Alcohol and Drug Abuse Prevention and Treatment (ADAPT) program. The Board found this contention without merit. The record indicates applicant was assessed by ADAPT through self­ referral and was released by the ADAPT program after his second offense. The Board found evidence to indicate the member was aware of the intolerance for underage alcohol consumption as well as the existence of programs in place to assist with any drug or alcohol dependence, regardless of the method of enrolling in the programs. The Board did not find evidence to support applicant's contention that the commander or first sergeant was negligent in failing to refer him to ADAPT. The records indicated the applicant received a Vacation of Suspended Nonjudicial Punishment and one Article 15, both for underage consumption of alcohol. The Board reviewed the entire record and found no evidence of impropriety or inequity to warrant an upgrade of the discharge

CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.

In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should remain unchanged.
