GENERAL: The applicant appeals for upgrade of discharge to honorable, to change the reason and authority for the discharge, and to change the reenlistment code.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDING: The Board denies the upgrade of the discharge to honorable and change of reenlistment code. However, the Board approved the change of reason and authority for discharge.
ISSUE:
Applicant contends discharge was improper by discharging him under "Commission of a Serious Offense" since his alleged misconduct did not carry the maximum penalty in the UCMJ of a punitive discharge. The records indicated the applicant received a Summary Court Martial for being absent without authority. Applicant also received three Letters of Reprimand. His misconduct included failure to pay just debt, dorm room insecure and in complete disarray and failure to report to two mandatory appointments. The applicant was discharged for a commission of a serious offense under AFI 36-3208 para. 5.52. In order to be discharged under this paragraph, member must have committed misconduct for which punitive discharge for the same or closely related offense under the UCMJ.
The DRB was pleased to see that the applicant was doing well and has matured since his departure from the Air Force. However, no inequity in his discharge was suggested or found in the course of the hearing. The Board concluded the misconduct of the applicant appropriately characterized his term of service. However, based upon the record and evidence provided by applicant, the Board finds the applicant's reason and authority for discharge improper. For this case, a punitive discharge was not authorized under the UCMJ
CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should remain unchanged. However, in view of the foregoing findings, the Board concludes that the reason for the discharge is more accurately described as Secretarial Authority based on the separation code being improper under the provisions of Title 10, USC 1553.
