l GENERAL:       The applicant appeals for upgrade of discharge to honorable, to change the reason and
! authority for the discharge, a1d to change the reenlistment code.

! The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDING:         Upgrade of the discharge, change of reason and authority for discharge, and change of
j reenlistment code are denied.

'' The Board finds foat neither the evidence of record nor that provided by the applicant substantiates an
I inequity or impropriety faat would justify a change of discharge.
IIISSUE: The record indicates that the applicant was discharged for Misconduct-Drug Abuse. Applicant contends her discharge is inequitable because her ability to serve was impaired due to marital issues and emotional trauma. She also cites inequity because her service prior to discharge was not considered at the time of discharge. The applicant states her discharge was improper because she was advised against
! requesting a period of probation. AFI 36-3208, paragraph 7.2.6.7, states that airman are not eligible for
1 probation and rehabilitation (P&R) if the reason for discharge is drug abuse.  The record indicates the
l applicant wrongfuiiy used marijuana on or about 12 May 2010 and 24 June 2010. According to AFI 36-
3208, paragraph 5.54, Misconduct: Drug Abuse, drug use is incompatible with military service and Airman who abuse drugs one or more times are subject to discharge. Drug abuse for the purpose of this regulation is the illegal, wrongful, or improper use, possession, sale, transfer, or introduction onto a military installation of any drug. This includes improper use of prescription medication. The term drug includes any controlled
substance in schedu.ies I, II, III, IV, and V of Title 21 U.S.C., Section 812. After review of the record, the
1IBoard found no evidence to indicate that the applicant did not know right from wrong or that in her two
' years and two months of service was unaware of the Air Force policy of zero tolerance to drug use. The
Board found the negative aspects of the willful misconduct outweighed the positive aspects of the applicant's performance and concluded that the discharge was appropriate.

In addition to the non-judicial punishment for Drug Abuse, applicant received a Letter of Counseling. Her misconduct includeci disobeying an order from supervisor and lied. The Board opined that through these administrative actions, the applicant had ample opportunities to change her behavior. They found the seriousness of the willful misconduct offset any positive aspects of the applicant's duty performance. The Board reviewed the entire record and found no evidence of impropriety or inequity to warrant an upgrade of the discharge.

Applicant states that her discharge did not take into account the good things she did while in the service. The DRB took note of the applicant's duty performance as documented by her performance reports, letters of recommendation and other accomplishments. They found the seriousness of the willful misconduct offset any positive aspects of the applicant's duty performance. The Board concluded the discharge was
appropriate for the reasons which were the basis for this case.


CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.

 In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should remain unchanged.
