GENERAL: The applicant appeals for upgrade of discharge to honorable, to change the reason and authority for the discharge, and to change the reenlistment code. The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record. The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. FINDING: The request for the upgrade of the discharge, to change the reason and authority for discharge, and to change the reenlistment code is denied. ISSUE: applicant received a General discharge for Misconduct - Other (Primary) and Failure in Alcohol Abuse Treatment -Unwillingness to Cooperate (Secondary) Applicant submitted no issues regarding the inequity or impropriety of his discharge. The applicant does submit that he believes he deserves an upgrade based on the fact he has matured since his discharge and is no longer dependent on alcohol. The record indicates the applicant received two Letters of Admonishment, two Letters of Reprimand, three Letters of Counseling and a Record of Individual Counseling. His misconduct included failed to obey an order to have two serviceable uniforms, failed to provide correct phone number, failed to go to scheduled appointment, failed to obey an order to have serviceable chef whites, failed to go to duty on time, failed to secure cash box, failed to maintain kitchen to Air Force standards, failed to maintain uniforms within Air Force Standards, failed to obey order from a NCO, failed to obey no contact order, failed to obey direct order to report to duty on two separate occasions and absent without leave on those two occasions. In addition to his misconduct, on 9 Jan 2008 the applicant was considered an Alcohol and Drug Abuse Program treatment failure based on his pattern of non-compliance with the program. The Board opined that through these administrative actions, the applicant had ample opportunities to change his behavior. Although the Board was pleased to hear that the applicant was no longer dependent on alcohol, no inequity or impropriety in his discharge was suggested or found in the course of the hearing. The Board concluded the misconduct of the applicant appropriately characterized his term of service.
CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should remain unchanged. Attachment: |
