GENERAL: The applicant appeals for upgrade of discharge to honorable. The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and requests that the review be completed based on the available service record. The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. FINDING: The Board denies the upgrade of the discharge. ISSUE: Applicant received a General discharge for Misconduct - Minor Disciplinary Infractions (Primary) and Mental Disorders - Personality Disorder (Secondary) Applicant contends discharge was inequitable because it was too harsh. He states he was being treated for bi-polar disorder during his service and was unable to make appropriate judgment calls regarding his misconduct. The records indicated the applicant received one Article 15 and two Letters of Reprimand. His misconduct included failed to complete gas mask fit test and airfield driving CBT within allotted time, attempted to call in sick without quarters slip, wore improper rank on uniform, lost military bearing during change of command, and endeavored to impede investigation by deleting text messages. Additionally, on 12 Aug 2012 the applicant was diagnosed with a borderline personality disorder that was so severe that his ability to function effectively in the military environment was significantly impaired. After a complete and thorough review of the applicant's records the Board found his contention to have no merit. There is no evidence the applicant was ever treated for bi-polar disorder. Furthermore, the primary reason for discharge was related to the applicant's misconduct, not a mental disorder. They found no inequity or impropriety in his discharge and concluded the misconduct of the applicant appropriately characterized his term of service.
CONCLUSION: The Discharge Review Board concludes that the discharge was consistent with the procedural and substantive requirements of the discharge regulation and was within the discretion of the discharge authority and the applicant was provided full administrative due process.
In view of the foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of discharge and determines the discharge should remain unchanged. Attachment: Examiner's Brief |
