The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined and reques : _,,o.c ':i1e ;c i.e'.v       ccmpletc:a -:J sei. on he avai:iahie service record.

FINDING:         1 request for the upgrade of the discharge, to ;:;hange the reason and authority for discharge, and to char."";;: }-.e reenlistment code are denied.

ISSUE: A.,.p: cc:nt re:.:,0v.::6 c. General disc:1arge for Commission of a Serious Offense.

Applicant submitted no issues regarding the inequity or impropriety of his discharge. The applicant does submit that ; believes he cieserves a second chance despite his discrepancies so that he may serve his country in L ;Air Nationa: Guard. The record indicates the applicant pled guilty and was convicted under a Special Cou Martial. His conviction was cased on with intent to deceive made a false statement to a
special agent and set fire to his POV with intent to defraud insurer. The Board found the seriousness of the willful misc-J:.1duct offs::t any positive aspects cf the applicant's duty performance. The Board concluded the discharge w -s approprc.te for the reasons w:1ic:1were the basis for this case.

CONCLU ON: The Discharge Review Board concludes that the ·discharge was consistent with the procedural c. :d substantive requirements of the discharge regulation and was within the discretion of the discharge m.cthority and the applicant was provided full administrative due process.

In view of       foregoing findings, the Board further concludes that there exists no legal or equitable basis for upgrade of cischarge and determines the discharge should remain unchanged.
