GENERAL: The applicant appeals for upgrade of discharge to honorable.
The applicant was offered a persolla1 appearance before the Discharge Review Board (DRB) but declined to
exercise this right.
The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDINGS: Upgrade of discharge is denied.
The Board finds that neither thc evidence of record nor that provided by the applicant substa~~tiates an
inequity or impropriety that would justify a changc of discharge.
ISSUE: The applicant contends discharge was inequitable because it was too harsh and did not take into
account his medical condition. The member was being treated for recurrent ear infections while on active
duty. Following a review of all available facts and evidence in the case, the Board found no causal or
mitigating relationship between the member's instances of misconduct and his medical condition. The
records indicated the applicant reccived three Article 15s, two Letters of Reprimand, one Letter of
Counseling, and six Records of Individual Counseling for misconduct. The misconduct included on divcrs
occasions, substandard job performance, failure to complete assigned training, failure to go, dereliction of
duty, and being late for work. The DRB opined that through these administrativc actions, the applicant had
ample opportunities to change his negative behavior. The Board concluded the misconduct was a significant
departure from conduct expected of all military members. The characterization of the discharge reccived by
the applicant was found to be appropriatc.
CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of thc
discharge authority and that the applicant was provided f'ull administrative due process.
In view of the foregoing findings the Board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

Upgrade, states as follows:
1.
I entered the United States Air Force in June 1999. I did so for several reasons
including to further my education; and to reestablish, in a disciplined way, the pursuit of my career
path and goals after the untimely death of my younger brother. Both of my grandfathers were
veterans of World War 11, and my father served as a Ranger and Forward Observer in Vietnam. Two
of my uncles served in the Air Force, and one in the United States Navy. All served honorably.

My enlistment period was for four (4) years.
For basic training, I was assigned and completed my initial training at Lackland Air
Force Base, San Antonio, Texas.

I, thereafter, transferred to Sheppard Air Force Base, Wichita Falls, Texas, and
entered Technical School upon my selection of Radiology as my course of study. Having no
previous course work in Radiology, as did many others in my class, I was reassigned and completed
course work as a Medical Records Technician.

My initial assignment following receipt ofmy diploma was to Offutt Air Force Base,
Omaha, Nebraska at Erhling Berquist Air Force Hospital.

Included in my general job duties and responsibilities, in no particular order, among
others, were initial creation of patient records, retrieval of record entries for patients from areas
throughout hospital, checking idchecking out records to various departments, keeping records filing
up to date, retiring completed patient files, various administrative assignments such as acting as desk
customer service representative, etc.

To maintain general medical records technician job responsibility currency, I was
additionally scheduled for ongoing course work (CDC training).

In this assignment, I was generally scheduled to the day shift working 8:00 a.m. to
5:00 p.m. Monday through Friday, reporting to the Medical Records area of the hospital under the
supervision of Staff Sergeant :

In addition to this assignment, I also pulled periodic security duty responsibilities at
the hospital to protect against unauthorized entry. Following the September 1 1,2001 tenorist attack
on our nation, my security detail assignment became more regular and urgent. Ln fact, my security
detail scheduling frequently extended into weekday evening hours and included duty on weekends.
10. My hospital security assignment required additional security team training, both in
the classroom and in the field. This training, too, was ongoing.

Up until approximately 12 to 18 months before my expected normal tour of duty
completion (end ofMay 2002), my duty assignments proceeded uneventfully. However, this is not

12. At no time during my reporting to my immediate supervisor was it ever made known
to me that anything about my performance might jeopardize my ability to successfblIy complete my
tour of duty.

This is true, even though I was continually suffering from ear infections brought
about in large part by problems with blockages in my ear canal drainage tubes. For these problems,
I received antibiotics and other medical assistance fiom the hospital's clinic staffto relieve my fever,
distress and discomfort.

Individual Counseling, dated 5 March 2002. (Atch 1-6)
g. On 15 February 2002, you failed to go to your appointed place of duty. For this incident
you received Nonjudicial Punishment, dated 13 March 2002, consisting of a suspended reduction
to the grade of Airman First Class and fifteen days extra duty. In addition, this action established

h. On 25 March 2002, you failed to go to your appointed place of duty. For this incident you
received Vacation of Suspended Nonjudicial Punishment, dated 18 April 2002, consisting of
reduction to the grade of Airman First Class, with a new date of rank of 13 March 2002. In

i. On 9 May 2002, you failed to go to your appointed place of duty. For this incident you
received Nonjudicial Punishment, dated 23 May 2002, consisting of a suspended reduction to the
grade of Airman, twenty days extra duly, and a reprimand. In addition, this action was placed in

j. On 26 July 2002, you failed to report for a security team detail. For this incident you
