GENERAL:  The applicant appeals for upgrade of discharge to honorable. 

The applicant was offered a persolla1 appearance  before the Discharge Review Board (DRR) but declined to 
exercise this right. 

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge. 

FINDINGS:  Upgrade of discharge is denied. 

The  Hoard  finds  that  neither  the  evidence  of  record  nor  that  provided  by  the  applicant  substantiates  an 
inequity or impropriety that would justify  a change oldischarge. 

ISSUE: The Applicant states that his discharge did not take into account the fact that he has a sleeping 
disorder.  The medical records indicated that thc applicant participated in a civilian sleep study.  The sleep 
study concluded that the applicant had no significant degree of obstructive sleep apnea.  The records 
indicated the applicant received two Article  15s and three  1,ctters of Reprimand for misconduct.  The 
misconduct included late for work on numerous occasions, arrested and charged with Driving Under the 
Influence, speeding, and failure to go.  The DRB opined that through these administrative actions, the 
applicant had ample opportunities to change his negative behavior.  The Hoard concluded the misconduct 
was a significant departure from conduct expected of all military members.  The characterization of the 
discharge received by the applicant was found to be appropriate. 

CONCLUSIONS:  The  Discharge  Review  Board  concludes  that  the  discharge  was  consistent  with  the 
procedural  and  substantive  requirements  of  the  discharge  regulation  and  was  within  the  discretion  of the 
discharge authority and that the applicant was provided full administrative due process. 

In view of the foregoing findings the Board further concludes that there exists no legal or equitable basis for 
upgrade of discharge, thus the applicant's discharge sl~ould not be changed.

Issue 1:  That a sleeping disorder was responsible for my failure to show in 

a timely manner which led to an article fifteen and a misconduct discharge.  My 
squadron commander did not take into account due to my comments concerning my 
alarm clocks before I sought medical help.

SUBJECT:  Notification Memorandum 

1.  I am recommending your discharge from the United States Air Force for a Pattern of 
Misconduct, specifically, Conduct Prejudicial to Good Order and Discipline.  The authority for 
this action is AFPD 36-32 and AFI 36-3208, paragraph 5.50.2.  The most severe type of 
discharge authorized in this case is an Under Other Than Honorable Conditions (UOTHC) 
discharge, if the convening authority determines such characterization is warranted and directs 
initiation of a discharge board,  I am recommending that you be discharged with an Under 
Honorable Conditions (General) service characterization. 

2.  My reasons for this action are: 

a.  On or about 19 Oct 03, you were derelict in the performance of those duties in that you 
operated a motor vehicle under the influence of alcohol, in violation of North Carolina General 
Statue 20-138.1, as documented by an AF Form 366, Record of Proceedings of Vacation of 
Suspended Nonjudicial Punishment, dated 3 Nov 03; Letter of Reprimand (LOR), dated 3 Nov 
03; Intake Report, dated 19 Oct 03; Intoxilyzer Report, dated 19 Oct 03; Affidavit and 
Revocation Report of Chemical Analyst, dated 19 Oct 03; Affidavit and Revocation Report of 
Charging Officer, dated 19 Oct 03; North Carolina Uniform Citation, dated  19 Oct 03 (2 pgs);

willfully failed to obey the posted speed limit traveling 81 miles per hour in a 45 mile per hour 
zone, as it was your duty to do, in violation of North Carolina General Statute 20-141, as

by a Letter of Reprimand (LOR), dated 1 1 Apr 03. 

f.  On or about 1 Apr 03, you reported late to work, as documented by a Letter of Reprimand 

(LQR), dated 8 Apr 03. 

3* Copies of the documents to be forwarded to the Separation Authority in support of this 
recommendation are attached.  The commander exercising SPCM jurisdiction or a higher 
authority, will decide whether you will be discharged or retained in the Air F0rc.e.  If you are 
discharged, you will be ineligible for reenlistment in the Air Force, and any special pay, bonus, or 
education assistance funds may be subject to recoupment.

receive HIV screening. 

8.  Any personal information you furnish in rebuttal is covered by the Privacy Act of 1974.  A 
copy of AFI 36-3208, is available for your use at the orderly room.
