VI. Facts, Circumstances, and Legal Basis for Separation
a. Facts and Circumstances:
The complete facts and circumstances pertaining to the applicant's discharge from the Army are not contained in the available records. However; evidence of record shows that on 6 April 1994, the Command Staff Judge Advocate, requested authority to separate the applicant under the provisions of AR 635-200, Chapter 14, paragraph 14-12c. The applicant received a Company Grade Article 15, was reduced to PFC/E3, for making two false official statements and not being at her appointed place of duty. The applicant exceeded her Retention Control Point (RCP), and the command requested that she be separated from the service for the commission of a serious offense rather than exceeding her RCP. The applicant's election of rights are not contained in the available record and the analyst presumed Government regularity in the discharge process. On 18 April 1994, the Chief Enlisted Separations and Appeals Branch, disapproved the request and directed that the applicant be separated immediately with a characterization of service of general, under honorable conditions. On 5 May 1994, the separation authority waived further rehabilitative efforts and directed that the applicant be discharged with a characterization of service of general, under honorable conditions. b. Legal Basis for Separation:
Army Regulation 635-200 provides the basic authority for the separation of enlisted personnel. Paragraph 16-8 of this regulation sets forth the requirements for early separation of enlisted personnel due to reduction in force, strength limitations, or budgetary constraints. Army policy states that the service of personnel separated under this paragraph will be characterized as honorable unless an entry level separation is required by Chapter 3, section III.
c. Response to Issues, Recommendation and Rationale:
After a careful review of all the applicant's available military records for the period of enlistment under review, the issue and documents she submitted, the analyst determined that the characterization of service was improper, and recommends to grant relief in the form of an upgrade of the characterization of service to fully honorable. Army Regulation 635-200, Chapter 16, paragraph 16-8, states that the service of members separated per this paragraph will be characterized as honorable unless an entry level separation is required by Chapter 3, section III. In the absence of information to the contrary, the analyst was satisfied that all requirements of law and regulation were met and the rights of the applicant were fully protected throughout the separation process. However, the analyst determined that the reason for discharge was both proper and equitable.
