AIR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE FD-2003-00386

GENERAL: The applicant appeals for upgrade of discharge to honorable, change the reason and authority
for the discharge, and change the reenlistment code.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.

FINDINGS: Upgrade of Discharge, change of reason and authority for discharge, and change of
reenlistment code is denied.

The Board finds that neither the evidence of record nor that provided by the applicant substantiates an
inequity or impropriety that would justify a change of discharge.

ISSUE: Applicant contends discharge was inequitable because it was too harsh. The records indicated the
applicant received an Article 15 for stealing $766.00 from the Charleston AFB Bowling Alley. She also
received a Letter of Admonishment and two Records of Individual Counseling for being disrespectful to an
NCO, leaving her assigned job, being disrespectful to a Senior Airman and for disobeying a direct order.
The DRB opined that through these administrative actions, the applicant had ample opportunities to change
her negative behavior. The Board concluded the misconduct was a significant departure from conduct

expected of all military members. The characterization of the discharge received by the applicant was found
to be appropriate.

CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.

In view of the foregoing findings the board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

(Change Discharge to Honorable, and Change the RE Code, Reason and Authority

Issue 1: I am asking for my discharge to be upgraded so I can serve my
country once more. I cannot go back unless my re-enlistment code is upgraded.
I have went (sic) to Army and Navy recruiters and they told me to try this and
they will help me. I loved being in the service. I will do anything to be able
to wear the uniform again. I messed up once and I accept full responsibility
for what I did. I have not been in any trouble since then, I lost my AF career
for my dumb decision. I got an Article 15 and served punishment and then I was
separated. I'm asking for a chance to be able to go back in the service, and
the only way I can is too (sic) get the discharge upgraded. I have been out
since March 2001. I have corrected my mistake. I have a clean record. Please
give me a chance to have a career and prove to myself one mistake won't stop me
or hold me down. Thanks for your time. Also, I did well at my job and got an
achievement medal. Also, I got punished for my mistake by getting an Article
15. I lost 2 stripes and got 45 days extra duty and was restricted to CAFB.
What I don't understand is why after my Article 15 why did I get seperated (sic)
for the same thing? I feel like I was punished twice. I feel that by serving
punishment for the Article 15, I was punished enough. Please look into this and
give me a chance to serve again. I just don't believe I should have been
seperated (sic) if my commander had punished me already for the same thing.
Again, thank you. I have no copies of my Article 15, please review my records.

SUBJECT: Amended - Notification Memorandum

1. [am amending my recommendation for your discharge from the United States Air Force for a
Commission of a Serious Offense, specifically, Other Serious Offenses, and for a Condition that
Interferes with Military Service, specifically a Mental Disorder. The authority for this action is
AFT 36-3208, paragraphs 5.52.3, 5.11 and 5.11.1. Ifmy recommendation is approved, your
service will be characterized as general.

2. My reasons for this action are:

a. On or about 21 Sep 00, you committed larceny. Specifically, you stole $766.00, from the
Charleston Air Force Base Bowling Alley. For this conduct, you received an Article 15 w/atchs,
dated 24 Jan 01, which included punishment of reduction to the grade of airman (from senior
airman); forfeiture of $350 pay per month for two months; restriction to Charleston AFB, SC for
45 days; and 45 days extra duty (Atch 1a).

b. On 5 Jan 01,98 ai i meee Charleston AFB, diagnosed you
IAW DSM JV, with an Adjustment Disorder with Depressed Mood (Axis I: 309.0) and a
Personality Disorder Not Otherwise Specified with schizoid and compulsive features (Axis II:
oul .9). In his 9 Jan 01 memorandum to the 437 ACSC Cesta that your disorder

“is so severe” that your “ability to function effectively in the military environment is
significantly impaired” and, thus recommended that you be separated from the Air Force. These
facts are evidenced by the Results of Mental Health Evaluation w/atchs, dated 9 Jan 01. Also
attached is a 9 Mar 98 memorandum from 9M concerning results of your mental health
evaluation. In his 9 Mar 98 memorandum your were diagnosed as Axis I, No diagnosis, and
Axis II, Personality Disorder Not Otherwise Specified, 301.9, with schizoid and compulsive
features (Atch 1a).

 

3. Copies of the documents to be forwarded to the separation authority in support of this
recommendation are attached. The commander exercising SPCM jurisdiction or a higher
authority will decide whether you will be discharged or retained in the Air Force. If you are
discharged, you will be ineligible for reenlistment in the Air Force.

4. You have the right to consult counsel. Military legal counsel has been obtained to assist you.
An appointment will be made for you to consult the Area Defense Counsel, 963-4416, Building
503, Room 119, upon issuance of this notification. You may consult civilian counsel at your
own expense.
