AJR FORCE DISCHARGE REVIEW BOARD DECISIONAL RATIONALE FD2003-00119

GENERAL: The applicant appeals for upgrade of discharge to Honorable.

The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right.

The attached brief contains the available pertinent data on the applicant and the factors Jeading to the
discharge. |

FINDINGS: Upgrade of discharge is denied.

The board finds that neither the evidence of record nor that provided by the applicant substantiates an
inequity or impropriety, which would justify a change of discharge.

The applicant’s issues are listed in the attached brief.

Issue. The Board finds that the applicant submitted no issues contesting the equity or propriety of the
discharge, and after a thorough review of the record, the board was able to identify none. The records
indicated the applicant received two Article 15s, four Letters of Reprimand, one Letter of Counseling, and
one Letter of Admonishment for misconduct. The misconduct included being absent without authority,
failure to go, financial irresponsibility, later for work on four separate occasions, and disrespect for
superiors and chain of command. The DRB opined that through these administrative actions, the applicant
had ample opportunities to change his negative behavior. The Board concluded the misconduct was a
significant departure from conduct expected of all military members. The characterization of the discharge
received by the applicant was found to be appropriate.

CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.

In view of the foregoing findings the board further concludes that there exists no legal or equitable basis for
upgrade, thus the applicant's discharge should not be changed.

1. Iam recommending your discharge from the United States Air Force for minor disciplinary
infractions. The authority for this action is AFPD 36-32 and AFI 36-3208, Chapter 5, Section
H, Paragraph 5.49. If my recommendation is approved, your service will be characterized as
honorable or under honorable conditions (general). I am recommending that your service be
characterized as under honorable conditions (general).

2. My reasons for this action are:

a. On or about 11 Dec 01, you called SrA “bitch” after a conversation about
turnover procedures that she tried to explain. For this incident, you received a Letter of
Reprimand (LOR), dated 12 Dec 01.

b. On or about 9 Jul 02, you failed to show up to work on time, reporting 45 minutes late.
For this incident, you received a Letter of Counseling (LOC), dated 9 Jul 02.

c. Qn or about 10 Jul 02, you failed to show up to work on time, reporting 40 minutes late.
For this incident, you received a Letter of Admonishment (LOA), dated 10 Jul 02.

d. On or about 13 Jul 02, you failed to show up to work on time, reporting one hour late.
For this incident, you received a Letter of Reprimand (LOR) and established a Unfavorable
- Information File (UIF), dated 13 Aug 02.

h, On or about 27 Dec 02, without authority, you absented yourself from your unit, 1CMS,
located at 78 West Flightline Road, Langley AFB, Virginia, and did remain so absent until on
or about 1 Jan 03. On or about 30 Dec 02, at or near Langley AFB, Virginia, without authority,
you failed to go at the time prescribed to your appointed place of duty, an appointment with the
commander. For these incidents, your suspended Article 15 punishment of reduction to the
grade of Airman was vacated on 24 Jan 03.

3, Copies of the documents to support this recommendation are attached and will be forwarded
to the separation authority. The separation authority will make the findings and
recommendations required under 10 U.S.C. 2005(g) regarding recoupment of education
assistance funds, if applicable. The commander exercising special court-martial jurisdiction or
a higher authority will decide whether you will be discharged or retained in the Air Force and, if
you are discharged, how your service will be characterized. If you are discharged, you will be
ineligible for reenlistment in the Air Force and any special pay, bonus, or education assistance
funds may be subject to recoupment.

4. You have the right to consult counsel. Military legal counsel has been obtained to assist
you. I have made an appointment for you to consult the Area Defense Counsel, 54 Willow

Street, Bldg. 147, (757)764-5607 at /G4% hours on 31 Je y?__2003. You may consult
civilian counsel at your own expense.

5. You have the right to submit statements in your own behalf. Any statements you want the

separation authority to consider must reach me by _/G4 30 hours on 3 Le 2003
unless you request and receive an extension for good cause shown. I will send them to the

separation authority.

6. If you fail to consult counsel or to submit statements in your own behalf, your failure will
constitute a waiver of your right 1o do so.

7. You have been scheduled for a medical examination. You must report to the 1st Medical

Group, Physical Exam Section at //20 hours on > rep _. 2003 and an
additional examination will be scheduled if necessary.

8. Any personal information you furnish in rebuttal is covered by the Privacy Act of 1974. A
copy of AFI 36-3208 is available for your use in the unit orderly room.
