GENERAL: The applicant appeals for upgrade of discharge to Honorable.
The applicant was offered a personal appearance before the Discharge Review Board (DRB) but declined to
exercise this right,
The attached brief contains the available pertinent data on the applicant and the factors leading to the
discharge.
FINDINGS: Upgrade of discharge is denied.
The board finds that the applicant submitted no issues contesting the equity or propriety of the discharge,
and after a thorough review of the record, the Board was able to identify none that would justify a change of
discharge.
ISSUE: The applicant submitted no issues and requested that the review be completed based on the
available service record. The Board reviewed the entire record and found no evidence of impropriety or
inequity in this case on which to base an upgrade of discharge. The records indicated applicant had two
Article 15s, one for looking at another student’s answer sheet during a test and the other for being AWOL.
He also received one Letter of Reprimand, two Letters of Counseling, four AETC Forms 341, and four AF
Forms 173 for being out of his dorm room after curfew, failing his appraisals four times, failing his room
inspection twice, failing to secure his Standard Operating Instruction, failing to sign in, smoking during the
duty day in violation of Phase one, and violation of the Phase program for driving a POV and smoking.
The DRB opined that through these administrative actions, the applicant had ample opportunities to change
his negative/repetitive behavior. The Board concluded the disciplinary infractions were a significant
departure from the conduct expected of all military members. The Board found no evidence of impropriety
or inequity in this case on which to base an upgrade of discharge.
CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.
In view of the foregoing findings the board further concludes that there exists no legal or equitable basis for
upgrade of discharge, thus the applicant's discharge should not be changed.

1. [am recommending your discharge from the United States Air Force Pattern of misconduct
and Unsatisfactory Duty Performance. The authonity for this action is AFPD 36-32 and AFI 36-
3208, Chapter 5, Sections H and E, Paragraph 5.50 and 5.26. The primary reason for discharge
is paragaph 5.50. If my recommendation is approved, your discharge will be described as
honorable or general. I am recommending that your service be characterized as general.
2. My reasons for this action are: *
a. On or about 25 Aug 01, without proper authority, you absented yourself from your place of
duty, to wit: 334 Training Squadron, and did remain so absent until you were apprehended on or
about 27 Sep 01, for which you received nonjudicial punishment on 5 Oct 01, (Atch 1,

b. On 15 Aug 01, you violated the 2™ Air Force Phase Program restrictions, by driving a
privately owned vehicle (POV) during duty hours. In addition, you were also found smoking, for
these infractions, you received a Letter of Reprimand, dated 17 Aug 01. (Atch 1, Appendix B

c. On or about 4 Jun 01, you were derelict in the performance of your duties by failing to
exhibit academic integrity by looking at another students answer sheets during progress check

1. On 19 Mar 01, you were found in the hallway out of your dormitory room after the 2200 hours
curfew as noted on AETC Form 341 by Anglia dated 19 Mar 01. (Atch 1, Appendix L)
3. Copies of the documents to be forwarded to the separation authority in support of this
recommendation are attached. The commander exercising SPCM junisdiction or higher will
decide whether you will be discharged or retained in the Air Force, and, if you are discharged,
how your service will be characterized. If you are discharged, you will be ineligible for
reenlistment in the Air Force. Any special pay, bonuses, or education assistance funds may be
subject to recoupment.
4. You have the right to consult legal counsel. Military legal counsel has been obtained to assist
you. Ihave made an appointment for you to consult Wore d at Bldg 0701, Room

expense.
5. You have the right to submit statements on your Or Ol Any statements you want the
