GENERAL: The applicant appeals for upgrade of discharge to Honorable.

The applicant’s appeal was heard by the Discharge Review Board (DRB), at Scott AFB, IL on June 3, 2003.
The applicant did not appear.

The attached brief contains available pertinent data on the applicant and the factors leading to the discharge.
FINDINGS: Upgrade of discharge to Honorable 1s denied.

The Board finds that neither the evidence of record nor that provided by the applicant substantiates an
impropriety or an inequity that would justify upgrade of the discharge.

ISSUES: The applicant was discharged with a General Discharge for misconduct and, more specifically,
drug abuse. Member received an Article 15 for use of ecstasy, a Schedule J controlled substance. After
being served with notice of the discharge the applicant neglected to submit statements or consult counsel.
Applicant now states that he should have been given an honorable discharge because he was led to believe
he was being given an honorable characterization. The DRB, however, could discern no evidence of
impropriety in the processing of his discharge case. Nor was there any other indication of an inequity or
impropriety of any other sort. The DRB concluded that the characterization of the applicant’s discharge
was appropriate given the nature of the applicant’s misconduct.

CONCLUSIONS: The Discharge Review Board concludes that the discharge was consistent with the
procedural and substantive requirements of the discharge regulation and was within the discretion of the
discharge authority and that the applicant was provided full administrative due process.

Issue 1: I believe that I should have received an honorable discharge as
FD2002-0130

per ------- , GS-05 for the Retirement Seperations (sic) Division shows that box
14 of AF Form 100 was checked honorable. I feel this is an error of my
discharge document (DD 214). Also I would like to note that I did not serve a

total of 4 years active duty. Please make the appropraite (sic) corrections to
my discharge document. If you have any questions, please call.

" SUBJECT: Notification Memorandum

1. Iam recommending your discharge from the United States Air Force, Drug Abuse. ‘The
authority for this action is AFPD 36-32 and AFI 36-3208, paragraph 5.54. If my
recommendation is approved, your discharge will be described as an Under Honorable
Conditions (General) discharge.

2. My reasons for this action is that between on or about 25 Dec 2000 and on or about 31 Dec
2000, you did at or near Keesler Air Force Base, Mississippi, wrongfully use ecstasy, a Schedule
I controlled substance. For this you received an Article 15 dated 07 Dec 2001. Your punishment
was forfeiture of $300.00 pay, reduction to the grade of E-1, and 14 extra duty days.

3. Copies of the documents to be forwarded to the separation authority in support of this
recommendation are attached. The commander exercising SPCM jurisdiction or higher authority ~
will decide whether you will be discharged or retained in the Air Force and if you are discharged,
how your service will be characterized.

4, You have the right to consult counsel. Military legal counsel can be obtained to assist you. I
can make an appointment for you to consult the Area Defense Counsel (ADC) at Bldg 1000

on at hours. You may consult civilian
counsel at your own expense.

5. You have the right to submit statements in your own behalf. Any statements you want the
separation authority to consider must reach me by (allow 3 workdays) _ / £ Dec O /
unless you request and receive an extension for good cause shown. I will send them to the
separation authority.

6. If you fail to consult counsel or to submit statements in your own behalf, your failure will
constitute a waiver of your right to do so.

7. You have been scheduled for a medical examination. You must report to the Reid Clinic
(Bldg 6612) for the examination.

8. Any personal information you furnish in rebuttal is covered by the Privacy Act of 1974. A
copy of AFI 36-3208 is available for your use in the Unit Orderly Room.
9. Execute the attached acknowledgment and return it to me immediately.
