APPLICANT REQUESTS THAT:

He receive Incapacitation Pay (INCAP Pay) for the period of 
26 Sep 11 to January 2012.

APPLICANT CONTENDS THAT:

His request for INCAP Pay was not processed prior to his 
retirement on 1 Oct 12.

The applicant does not provide any supporting documentation.

His complete submission is at Exhibit A.

STATEMENT OF FACTS:

The applicant retired from the Air National Guard on 1 Oct 12 in 
the grade of master sergeant.

The remaining relevant facts pertaining to this application are 
contained in the letters prepared by the appropriate offices of 
the Air Force, which is at Exhibit C and D.

AIR FORCE EVALUATION:

NGB/A1PS recommends approval.  In this respect, they concur with 
the applicant’s request and recommends he receive INCAP Pay for 
the period of 23 Sep 11 to 17 Jan 12.  The applicant has 
provided sufficient documents associated with having a Line of 
Duty (LOD) Determination reflecting he was restricted from 
performing military duties.

The complete A1PS evaluation, with attachments, is at Exhibit C.

NGB/A1P concurs with the recommendation from A1P and recommends 
approving the applicant’s request to receive INCAP Pay.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to the 
applicant on 22 Mar 13 for review and comment within 30 days.  
As of this date, this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by 
existing law or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to 
demonstrate the existence of error or injustice that warrants 
corrective action.  After carefully reviewing the evidence of 
record, we agree with NGB/A1PS, Benefits and Entitlements 
Office, that the applicant receive INCAP Pay for the period 23 
Sep 11 to 17 Jan 12.  Therefore, we recommend his records be 
corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air 
Force relating to APPLICANT be corrected to show that competent 
authority approved his request for Incapacitation Pay for the 
period 23 September 2011 through 17 January 2012.
