APPLICANT REQUESTS THAT:

His DD Form 214, Armed Forces of the United States Report of Transfer or Discharge, be amended to reflect the following awards and decorations:

1.  Air Force Longevity Service Award (AFLSA). 

      2. Korea Defense Service Medal (KDSM) (Administratively Corrected).

      3. National Defense Service Medal (NDSM) (Administratively Corrected).

APPLICANT CONTENDS THAT:

He served 4 years in the Air Force and 13 months in the Republic of Korea.  These awards should have been included in his records.  

In support of his request, the applicant provides copies of his DD Form 214 and special orders.

STATEMENT OF FACTS:

The applicant enlisted in the Air Force on 7 Apr 1959 and was released from active duty on 5 Apr 1963.

The applicant served on active duty for 3 years, 11 months and  29 days. 

The AFLSA is awarded to all service members of the United States Air Force who complete 4 years of honorable active or reserve military service. 

Air Force Regulation 39-14A, Enlisted Personnel – Separation for the Convenience of the Government, dated 1 Mar 1960, paragraph 3n, states that a regular airman who does not intend to reenlist and whose normal expiration time of service separation date falls on a non-workday (Saturday, Sunday or a holiday) will be separated on the preceding workday.  The applicant’s DD Form   214 reflects he was separated under this rule on a Friday preceding his established date of separation on a Saturday.

AIR FORCE EVALUATION:

AFPC/DPSID recommends denial of the applicant’s request for the AFLSA.  The applicant does not meet the eligibility criteria since he did not serve 4 years.  To grant the applicant relief would be contrary to the eligibility criteria established by  Air Force Instruction 36-2803, The Air Force Awards and Decorations Program.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 25 Apr 2013, a copy of the Air Force evaluation was forwarded to the applicant for review and comment within 30 days.  As of this date, no response has been received by this office (Exhibit C).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or regulations.

2.  The application was not timely filed; however, it is in the interest of justice to excuse the failure to timely file.

3.  Sufficient relevant evidence has been presented to demonstrate the existence of error or injustice.  We note the Air Force office of primary responsibility recommends denial stating the applicant does not meet the eligibility criteria for award of the AFLSA.  However, the applicant was separated one day earlier than his established date of separation for the convenience of the government. The Board concludes that had the applicant’s separation date, through no fault of his own, not fallen on a weekend he would have completed his full four years.  Therefore, in the interest of justice, we recommend his records be corrected as indicated below.





THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air Force relating to APPLICANT, be corrected to show that he was awarded the Air Force Longevity Service Award.
