APPLICANT CONTENDS THAT:
The LOM was awarded after his retirement date.
In support of the applicants appeal, he provides a copy of the
LOM recommendation, LOM citation, LOM narrative, and other
documentation.

Exhibit A.

STATEMENT OF FACTS:
The relevant facts pertaining to this application, extracted
from the applicants military records, are contained in the
letter prepared by the appropriate office of the Air Force at
Exhibit B.

AIR FORCE EVALUATION:
SAF/MRBP recommends approval. MRBP states the applicant was
recommended for the LOM for retirement. The recommendation was
submitted to AFDW - where it was delayed due to the AFDW change
of command and the incoming commanders desire to make changes
to the decorations process for the organization. The package
was subsequently misplaced and not processed.
The applicant meets the time in position criteria of 18 months
as the Assistant Division Chief, Information Operations and
Special Activities Division, Operations, Directorate, US
European Command. He was in the position from 4 July 2009 to 30
September 2012.
Although the applicant was not in a qualifying position, his
individual accomplishments, as outlined in the narrative, meet
the criteria for award of the LOM upon retirement. Had this
award nomination been processed in a timely manner and sent to
the Air Force Decorations Board - it would have been approved.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 9 October 2013, a copy of the Air Force evaluation was
forwarded to the applicant for review and response within
30 days (Exhibit C). As of this date, no response has been
received by this office.

THE BOARD CONCLUDES THAT
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. We took
notice of the applicants complete submission in judging the
merits of the case and agree with the assessment and
recommendation of SAF/MRBP. Therefore, we recommend the records
be corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air
Force relating to APPLICANT be corrected to show that he was
awarded the Legion of Merit for exceptionally meritorious
conduct during the period from 4 July 2009 through 30 September
2012.

In recognition of the applicant's retirement on 1 June 2009, he was recommended for award of the LOM (in an undated letter) by the Chief, Astronaut Office. Due to the award period of the Mar 09 DMSM, that time and the STS-124 mission cannot be considered in the award of the retirement LOM. In our view, the evidence of record indicates it was clearly their intent that the applicant receive the Legion of Merit at retirement.
