APPLICANT REQUESTS THAT:

His Medical Continuation (MEDCON) orders be corrected to reflect 
the start date as 6 Nov 12, rather than 3 Dec 12.

APPLICANT CONTENDS THAT:

1. He injured both shoulders while supporting operation ENDURING 
FREEDOM and received a Line of Duty (LOD) for continued care.  
He received physical therapy and other none invasive care; 
however, his left shoulder ultimately required surgery.  It was 
not until after he had surgery that the National Guard Bureau 
(NGB) denied his request for MEDCON orders two days post-
surgery.  Once he provided the required documents to the NGB, 
they forwarded his request to the Air Force Medical Operations 
Agency (AFMOA) and MEDCON orders were provided with a start date 
of 3 Dec 12.

2. No action has been taken to correct the date of his MEDCON 
orders.  As such, he has had to use his civilian sick leave to 
off-set this issue.

In support of his request, the applicant provides a personal 
statement, a copy of a memorandum from the 153d Medical Group, a 
copy of his MEDCON orders, a copy of AF IMT 348, Line of Duty 
Determination, and a copy of his Leave and Earning Statement 
(LES).

STATEMENT OF FACTS:

The relevant facts pertaining to this application is contained 
in the letter prepared by the appropriate office of the Air 
Force, which is at Exhibit C.

AIR FORCE EVALUATION:

AFPC/DPFA recommends approval due to administrative delays.  
DPFA opines that due to the inconsistencies in the 
documentation, and the late notification of these 
inconsistencies identified by ANG/SGP staff, caused an 
administrative delay in the applicant being eligible for MEDCON 
orders.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the 
applicant on 10 Jul 13 for review and comment within 30 days.  
As of this date, this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by 
existing law or regulations.

2.  The application was timely filed.

3.  Sufficient relevant evidence has been presented to 
demonstrate the existence of error or injustice that warrants 
corrective action.  After reviewing the evidence of record, we 
agree with the opinion and recommendation of the Air Force 
office of primary responsibility to correct the applicant’s 
medical continuation orders to reflect a start date of 6 Nov 12 
through 30 May 13.  .  We have been advised by  AFMOA/SGHI that 
the applicant has been approved for an extension of these orders 
through 30 May 2013.  Therefore, we recommend the records be 
corrected as indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air 
Force relating to APPLICANT be corrected to show that he was 
placed on medical continuation orders effective 6 November 2012 
through 30 May 2013, rather than 3 December 2012 through 2 
January 2013.
