APPLICANT REQUESTS THAT:
1. Her Post-9/11 GI Bill Transfer of Educational Benefits (TEB)
be approved effective 28 January 2010.
2. Her Active Duty Service Commitment (ADSC) reflect 28 January
2010 [sic].

APPLICANT CONTENDS THAT:
She signed up for the TEB on 28 January 2010. At that time her
Expiration Term of Service (ETS) was 27 February 2014, which
gave her enough time to complete the four year service
commitment.
In support of the applicants appeal, she provides TEB documents
and a copy of her active duty enlisted brief.
The applicant's complete submission, with attachments, is at
Exhibit A.

STATEMENT OF FACTS:
The applicant is currently serving in the Regular Air Force in
the grade of master sergeant.
Any member of the Armed Forces on or after 1 August 2009, who,
at the time of the approval of the individual's request to
transfer entitlement to educational assistance under this
section, is eligible for the Post-9/11 GI Bill, has at least
6 years of service in the Armed Forces (active duty and/or
Selected Reserve) on the date of election and agrees to serve a
specified additional period in the Armed Forces from the date of
election.
The remaining relevant facts pertaining to this application,
extracted from the applicants military records, are contained
in the letter prepared by the appropriate office of the Air
Force at Exhibit B.

AIR FORCE EVALUATION:
AFPC/DPSIT recommends approval of the applicants initial
application on 29 January 2010, with an ADSC adjustment to
28 January 2014. DPSIT states prior to 24 August 2010, the vMPF
did not have the pop-up banner which asked members to verify
their email and phone numbers. It is entirely possible that the
applicant did not receive both the initial notification as well
as the rejection notice from the TFSC due to this.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 3 February 2013, a copy of the Air Force evaluation was
forwarded to the applicant for review and response within
30 days (Exhibit C). As of this date, no response has been
received by this office.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by
existing law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of an error or injustice. The
applicant contends that she never received notification that her
TEB application in January 2010 was rejected. We took notice of
the applicants complete submission in judging the merits of the
case and agree with AFPC/DPSIT recommendation. We note that
prior to 24 August 2010, the vMPF did not have the pop-up banner
which asked members to verify their email and phone numbers.
Therefore, due to this it is possible that the applicant did
not receive the initial notification as well as the rejection
notice from the TFSC. Therefore, we recommend the records be
corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air
Force relating to the APPLICANT, be corrected to show that:
a. On 29 January 2010, she elected to transfer her Post-9/11 GI
Bill Educational Benefits.
b. Her active duty service commitment date (ADSC) reflect
28 January 2014.

He submitted an application for the TEB on 13 March 2011 at which point he thought the application process was complete. The remaining relevant facts pertaining to this application, extracted from the applicants military records, are contained in the letter prepared by the appropriate office of the Air Force at Exhibit B. Without the signing of an SOU there is no way the TFSC has any idea the applicant wants the obligated four year ADSC that goes along with the transfer of the benefit.
