RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2012-04341
COUNSEL: NONE
HEARING DESIRED: NO
_________________________________________________________________
APPLICANT REQUESTS THAT:
His Career Status Bonus (CSB) election be authorized and changed
from Eligible, but did not elect CSB to Eligible and elected
CSB.
_________________________________________________________________
APPLICANT CONTENDS THAT:
He applied for CSB by completing the initial paperwork while he
was deployed. However, he was never notified by his local
Military Personnel Section (MPS) when his election was due. He
asked about his CSB when he reenlisted, but was told he would be
notified; however, he never was. As a result, he completed his
final paperwork after the expiration date.
The applicants complete submission, with attachments, is at
Exhibit A.
_________________________________________________________________
STATEMENT OF FACTS:
The applicant is currently serving in the Regular Air Force in
the grade of technical sergeant (E-6).
The remaining relevant facts, extracted from the applicants
master personnel records, are contained in the evaluation by the
Air Force office of primary responsibility at Exhibit C.
_________________________________________________________________
AIR FORCE EVALUATION:
AFPC/DPSOR recommends denial. DPSOR states the applicant was
notified on 8 February 2012 that he was eligible to receive the
CSB. By initialing the notification memorandum, the applicant
indicated he understood that he had until 8 August 2012 to make
an election and return the completed DD Form 2839, Career Status
Bonus (CSB) Election, to the Military Personnel Section.
Upon reviewing the applicants record in the Automated Records
Management System, there is a Notification of CSB Redux
Eligibility Memorandum included, dated 8 February 2012. However,
there is no DD Form 2839 in his record.
The complete AFPC/DPSOR evaluation, with attachment, is at
Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant
on 16 October 2012, for review and comment within 30 days
(Exhibit D). As of this date, this office has received no
response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Sufficient relevant evidence has been presented to
demonstrate the existence of an injustice. Based on the
available evidence of record, it appears the applicant has
established reasonable doubt as to whether he was miscounseled
regarding the CSB election process. We believe the applicants
intent was to elect CSB; however, due to his deployment situation
and the fact that he believed that he would be notified when his
CSB election was due, he missed the deadline to return the
appropriate paperwork. We note the recommendation and rationale
provided by the Air Force office of primary responsibility;
however, given the circumstances of this case, we believe it to
be in the interest of equity and justice to grant the requested
relief. Accordingly, we recommend the applicants record be
corrected as indicated below.
_________________________________________________________________
THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force
relating to APPLICANT be corrected to show that he completed a
Department of Defense Form 2839, Career Status Bonus (CSB)
Election, effective 6 August 2012, and competent authority
approved his Career Status Bonus.
