RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2011-04058
COUNSEL: NONE
HEARING DESIRED: NO
_________________________________________________________________
APPLICANT REQUESTS THAT:
His Active Duty Service Commitment (ADSC) be reaccomplished to
reflect an initial application date of 12 November 2009 instead
of the current date of 27 April 2011.
_________________________________________________________________
APPLICANT CONTENDS THAT:
He initially applied for TEB on 12 November 2009; however, he
realized the transfer was never completed on 26 April 2011.
Therefore, he quickly reaccomplished the transfer on 27 April
2011.
When he initially enrolled on the official website for TEB
everything seemed complete. There was no indication there was
any additional steps required for completion of the process.
In support of his appeal, the applicant provides copies of his
permanent change of station (PCS) orders, training allocation
notification, In-processing checklist, TEB discussion thread
(2011), and a Department of Veteran Affairs (DVA) confirmation of
TEB election, dated 28 May 2009.
The applicants complete submission, with attachments, is at
Exhibit A.
_________________________________________________________________
STATEMENT OF FACTS:
The applicant is currently serving in the Regular Air Force in
the grade of lieutenant colonel (O-5).
The remaining relevant facts, extracted from the applicants
military service records, are reflected in the evaluation by the
Air Force office of primary responsibility at Exhibit B.
_________________________________________________________________
AIR FORCE EVALUATION:
AFPC/DPSIT recommends denial. DPSIT states that the AFPC Service
Center received the applicants initial TEB application request
on 16 November 2009. However, in order to complete the request
he had to complete the Statement of understanding (SOU). The
applicant failed to complete the SOU and his application for TEB
expired on 7 January 2010. He did not reapply for TEB until
27 April 2011, at which time his request was approved.
The complete AFPC/DPSIT evaluation is at Exhibit C.
_________________________________________________________________
APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 10 November 2011, a copy of the Air Force evaluation was
forwarded to the applicant for review and comment within 30 days
(Exhibit C). As of this date, this office has received no
response.
_________________________________________________________________
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. We took notice
of the applicant's complete submission in judging the merits of
the case; however, we agree with the opinion and recommendation
of the Air Force office of primary responsibility and adopt its
rationale as the basis for our conclusion that the applicant has
not been the victim of an error or injustice. Therefore, in the
absence of evidence to the contrary, we find no basis to
recommend granting the relief sought in this application.
________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that
the application was denied without a personal appearance; and
that the application will only be reconsidered upon the
submission of newly discovered relevant evidence not considered
with this application.

The message states in part: "Within 72 hours you will receive an Air Force Personnel Center (AFPC) email with "TEB INCIDENT" in the subject line, stating that your AF Form 4406 is ready for signature. The date on the SOU provided by the applicant reads 9/6/2011. The applicant did not complete the TEB SOU and therefore his 20 May 11 TEB application could not be approved.
AF | BCMR | CY2012 | BC-2012-00720
The complete AFPC/DPSIT evaluation is at Exhibit B. He believes his ADSC should be 9 June 2015 based on his original intent for the TEB and the fact that he did not receive an email concerning the SOU and an expired TEB application. We note the applicant’s assertion that he suffered an injustice when he did not receive an email concerning the SOU and an expired TEB application; however, he has not provided sufficient evidence to support that he was treated any differently than other...

In support of his appeal, the applicant submits the 17 Jul 13 e-mail from the TFSC stating that his application was rejected; a print-out from the milConnect website showing that he applied for his benefits in Aug 11 and inputted a request to transfer months of his benefits to his dependents; an AF Form 1411, Extension of Enlistment in the Air Force, which validates that he extended in order to qualify for TEB transfer; and an unsigned SOU. While the applicant did complete an extension for...

He submitted an application for the TEB on 13 March 2011 at which point he thought the application process was complete. The remaining relevant facts pertaining to this application, extracted from the applicants military records, are contained in the letter prepared by the appropriate office of the Air Force at Exhibit B. Without the signing of an SOU there is no way the TFSC has any idea the applicant wants the obligated four year ADSC that goes along with the transfer of the benefit.
