APPLICANT REQUESTS THAT:
His DD Form 214, Certificate of Release or Discharge from Active
Duty, Item 4a, Grade, Rate or Rank, be amended to reflect the
grade of staff sergeant (SSgt) rather than senior airman (SrA)
and item 4b, Pay Grade, be amended to reflect E5 rather than E4.

APPLICANT CONTENDS THAT:
He believes he should have been separated as a SSgt since an
amendment to his separation order, dated 14 November 2005,
indicates item 20H amended to read SSgt.
In support of his request, the applicant provides documents
extracted from his military personnel records.

STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force 11 December 2001.
On 10 December 2005, the applicant was honorably released from
active duty in the grade of senior airman, effective and with a
date of rank of 12 June 2004, under the provisions of AFI 36-
3208, Completion of Required Active Service and transferred to
the Air Force Reserve. He served 4 years on active duty.
AF Form 973, Request Authorization for Change of Administrative
Orders, Item, 6, Remarks, reflects Item 20H as SSgt.

AIR FORCE EVALUATION:
AFPC/DPSOE recommends denial. DPSOE states the applicant was
considered and tentatively selected for promotion to SSgt during
cycle 05E5. He received PSN 10612.5 which would have incremented
1 May 2006; however, the applicant separated from active duty
effective 10 December 2005 (5 months prior to his pin-on date).
In accordance with AFI 36-2502, Table 2.1, airmen must serve on
continuous active duty until the effective date of promotion.
Therefore, the applicant was separated in the correct rank of SrA
and the amendment to the separation order, item 20H, is in error.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
On 8 October 2010, a copy of the Air Force evaluation was
forwarded to the applicant for review and comment within 30 days
(Exhibit D). As of this date, this office has received no
response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was not timely filed; however, it is in the
interest of justice to excuse the failure to timely file.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of error or injustice. The applicants
contentions are duly noted; however, after reviewing the evidence
of record we agree with the opinion and recommendation of the Air
Force office of primary responsibility and adopt its rationale as
the basis for our conclusion the applicant has not been the
victim of an error or injustice. Therefore, we find no basis to
recommend granting the relief sought.

THE BOARD DETERMINES THAT:
The applicant be notified the evidence presented did not
demonstrate the existence of an error or injustice; the
application was denied without a personal appearance; and the
application will only be reconsidered upon the submission of
newly discovered relevant evidence not considered with this
application.

A suspended reduction to the rank of SSgt would have more appropriate for a first time offense. The reduction to the rank of Senior Airman (SrA, E-4) as a result of Nonjudicial Punishment (NJP), UCMJ was mitigated to a fine of $1,000.
