APPLICANT REQUESTS THAT:

He be awarded Vietnam campaign awards.

APPLICANT CONTENDS THAT:

His Vietnam campaign awards are missing from his records.

In support of his request, the applicant provided a  copy  of  his  DD
Form 214, Armed Forces of the United  States  Report  of  Transfer  or
Discharge.

His complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

Applicant’s military personnel records reflect he enlisted  on  active
duty on 11 July 1966 for 4 years.

On 7 June 1970, he was honorably discharged in  the  grade  of  airman
first class (E-3).

He served 3 years, 10 months and 27 days on active duty.

AIR FORCE EVALUATION:

AFPC/DPAPP recommends denial.  DPAPP states  while  they  can  confirm
boots on the ground in Thailand, they cannot  determine  how  long  he
served or verify any  service  in  Vietnam.   His  military  personnel
records did not contain documents confirming service.

The complete DPAPP evaluation, with attachments, is at Exhibit B.

AFPC/DPSIDR recommends  denial.   DPSIDR  states  the  Directorate  of
Assignments (DOA)  was  unable  to  verify  the  applicant  served  in
Vietnam.  They could only verify one  day  in  Thailand  when  he  was
receiving  medical  treatment.   Without  official  documentation   of
service in Vietnam, they are  unable  to  verify  his  entitlement  to
Vietnam awards.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant on
16 May 2008 for review and comment within 30 days.  As of  this  date,
this office has received no response (Exhibit D).

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies  provided  by  existing
law or regulations.

2.    The application was not timely filed;  however,  it  is  in  the
interest of justice to excuse the failure to timely file.

3.    Insufficient relevant evidence has been presented to demonstrate
the existence of error or injustice.  After a thorough review  of  the
available evidence and the applicant’s complete submission, we find no
evidence, and are not persuaded by his assertions,  that  his  records
should be corrected to show he was awarded  Vietnam  era  awards.   As
such, we agree with the opinions and recommendations of the Air  Force
offices of primary responsibility and adopt  their  rationale  as  the
basis for our conclusion that the applicant has not been the victim of
an error or injustice.  Therefore, in the absence of evidence  to  the
contrary, we find no compelling basis to recommend granting the relief
sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented did  not  demonstrate
the existence of  error  or  injustice;  the  application  was  denied
without a personal  appearance;  and  the  application  will  only  be
reconsidered upon the submission of newly discovered relevant evidence
not considered with this application.
