RECORD OF PROCEEDINGS
AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS
IN THE MATTER OF: DOCKET NUMBER: BC-2007-02767
INDEX CODE: 110.00
COUNSEL: None
HEARING DESIRED: No
_________________________________________________________________
APPLICANT REQUESTS THAT:
His reenlistment eligibility (RE) code 2C “Involuntarily separated
with an honorable discharge; or entry level separation without
characterization of service” be changed to allow him to reenter
military service.
_________________________________________________________________
APPLICANT CONTENDS THAT:
He has an invalid RE code.
In support of his request, the applicant provided a copy of his DD
Form 214.
Applicant's complete submission, with an attachment, is at Exhibit A.
_________________________________________________________________
STATEMENT OF FACTS:
The applicant enlisted in the Regular Air Force (RegAF) on 13 Mar 07,
as an airman basic (AB) for a period of six years.
On 18 Jun 07, he was discharged under the provisions of Air Force
Instruction (AFI) 36-3208, Administrative Separation of Airman (entry-
level performance and conduct), with an uncharacterized entry-level
separation. The applicant served on active duty for three months and
six days.
_________________________________________________________________
AIR FORCE EVALUATION:
HQ AFPC/DPSOS recommends the requested relief be denied. DPSOS states
based upon the documentation in the applicant's records, the
applicant’s discharge was consistent with the procedural and
substantive requirements of the discharge regulation. The discharge
was within the sound discretion of the discharge authority and he did
not submit any evidence or identify any errors or injustices that
occurred in the discharge processing. In addition, he did not provide
any facts to warrant a change to his RE code.
Air Force policy is that entry-level separations/uncharacterized
service characterizations are given to service members who have not
completed more than 180 days of continuous active service. The
Department of Defense (DOD) determined if a service member served less
than 180 days of active service, that it would be unfair to the member
to characterize that service. The applicant's uncharacterized service
is correct and in accordance with DOD and Air Force Instructions.
The complete AFPC/DPSOS evaluation is at Exhibit C.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on
21 Sep 07, for review and comment within 30 days. As of this date, no
response has been received by this office.
_________________________________________________________________
THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing
law or regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to
demonstrate the existence of an error or an injustice. Applicant’s
contentions are duly noted; however, we are not persuaded that the
applicant has been the victim of an error or injustice. At the time
members are separated from the Air Force, they are furnished an RE
code predicated upon the quality of their service and circumstances
of their separation. After a thorough review of the evidence of
record, we believe that given the circumstances surrounding the
applicant’s separation, the RE code issued was in accordance with the
appropriate directives. Therefore, we find no basis upon which to
recommend favorable action on this application.
_________________________________________________________________
THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not
demonstrate the existence of material error or injustice; that the
application was denied without a personal appearance; and that the
application will only be reconsidered upon the submission of newly
discovered relevant evidence not considered with this application.

She provided no facts warranting changing the narrative reason for separation to “fulfillment of service” or a change to her RE code. It appears the specific reasons for this action was that she had back problems prior to entry on active duty but failed to disclose these problems until she was in BMT. In addition, SGPS states if the findings of the Board are in favor with the applicant, they can support her request to change her RE Code from “Fraudulent Entry” to "Not Medically Qualified.” The complete SGPS evaluation is at Exhibit C. We are not persuaded by the evidence presented that the uncharacterized entry-level separation received by the former member should be changed to an honorable discharge. Rather, an entry-level separation with uncharacterized service is used in those cases where the member has not yet completed six months of service at the time separation proceedings were, for whatever reason, initiated. However, after a thorough review of the applicant's submission and the evidence of record, we see no...
