APPLICANT REQUESTS THAT:

His DD Form 214, Certificate of Release or Discharge from Active Duty,  does
not list the Army Good Conduct Medal  (GCM),  the  Air  Force  Good  Conduct
Medal (AFGCM) or the National Defense Service Medal (NDSM).

APPLICANT CONTENDS THAT:

During his enlistment in the Army Air Corp, the  transition  was  made  into
the Air Force uniform which he believes entitles him to  both  the  GCM  and
AFGCM.

He also served between 1949 and 1952 which falls within the criteria of  the
NDSM.

The applicant has submitted a copy of his DD Form 214, an  unknown  extract,
paragraph 63, untitled and undated concerning the AFGCM, and a statement.

The applicant's complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant entered active duty on 29 Apr 49 and served for a  period   of
3 years and 7 months.  His  date of separation  was 28 Nov 52.

AFPC/DPPPR reviewed the applicant’s records and verified he is  entitled  to
the GCM and NDSM.  The applicant’s DD Form 214 will be corrected to  reflect
the aforementioned awards.

Note: In accordance with AFI 36-2803, the Air Force Good Conduct  Medal  was
authorized by Congress on 6 Jul 60, with the creation of  other  medals  for
the Air Force.  The  medal  was  not  created  until  1  Jul  63,  when  the
Secretary of the Air Force established it.  It  was  awarded  to  Air  Force
enlisted personnel for exemplary  conduct  during  a  three-year  period  of
active duty military service or for a one-year period of  service  during  a
time of war.  Persons  awarded  this  medal  must  have  had  character  and
efficiency ratings of excellent or higher throughout the qualifying  period,
including time spent in attendance at Service schools, and there  must  have
been  no  convictions  by  court  martial  during  this  period.  Air  Force
personnel who were previously awarded the GCM and after 1 Jun 63,  qualified
for the AFGCM could wear both medals.

AIR FORCE EVALUATION:


AFPC/DPPPR recommends denial of the AFGCM.   The  AFGCM  was  authorized  by
Congress on 6 Jul 60.  The applicant’s enlistment was from 29 Apr 49  to  28
Nov 52; therefore, he is not eligible for the AFGCM.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 19  Jan
07 for review and comment within 30 days.  As of this date, this office  has
not received a response.


THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of  error  or  injustice.   We  took  notice  of  the  applicant's
complete submission in judging the merits of the  case;  however,  we  agree
with the opinion and recommendation of  the  Air  Force  office  of  primary
responsibility and adopt its rationale as the basis for our conclusion  that
the applicant has not been the victim of an error or injustice.   Therefore,
in the absence of evidence to the contrary, we find no compelling  basis  to
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
