APPLICANT REQUESTS THAT:

He be awarded the Purple Heart (PH) Medal.

APPLICANT CONTENDS THAT:

He received injuries to his right knee in 1969 while  at  DaNang  Air  Base,
Vietnam, when he was blown off the top of an aircraft shelter from a  rocket
or mortar.

Applicant provides no supporting documentation.  The applicant’s  submission
is at Exhibit A.

STATEMENT OF FACTS:

On 31 March 1964, the applicant enlisted in the Regular  Air  Force  at  the
age of 21.  The applicant was progressively promoted to the  rank  of  staff
sergeant (E-5), effective and with a date of rank of 1  December  1968.   He
served in DaNang Air Base, Vietnam from  16  February  1969  to  26  January
1970.

On 31 March 1984, the applicant was honorably relieved from active duty  for
voluntary retirement and retired  effective  1 April  1984.   He  served  20
years and 1 day of active duty of which 5 years, 4 months,  and  1  day  was
foreign service.

AIR FORCE EVALUATION:

AFPC/DPPPRA recommends the applicant’s request  be  denied.   DPPPRA  states
the applicant was notified on 1 September 2006 of the criteria for award  of
the PH  Medal  and  asked  to  provide  additional  information  that  would
substantiate his claim.  The  applicant  did  not  respond.   DPPPRA  states
there is no evidence in the  applicant’s  military  or  medical  records  to
support he was injured as a direct result of enemy action;  therefore,  they
are unable to verify his entitlement to the PH Medal.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 3 November 2006, a copy of the Air Force evaluation  was  forwarded  to
the applicant for review and comment within 30 days.   As  of  this  date,
this office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  After a thorough review of  the  available
records, we found no evidence that the applicant is eligible for  the  award
of the Purple Heart Medal.  The applicant did not  provide  any  documentary
evidence to substantiate his claim that he was wounded as  a  direct  result
of enemy action, or that he was recommended  for,  or  awarded,  the  Purple
Heart Medal.  The personal sacrifice the applicant endured for  his  country
is noted and the recommendation to deny  the  requested  relief  in  no  way
diminishes the high regard we have for his service.  Nevertheless,  in  view
of the above, we find no basis to favorably consider this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
