APPLICANT REQUESTS THAT:
He be awarded a Meritorious Service Medal (MSM) for service during the
period 26 November 2002 to 21 October 2005 while stationed at Elmendorf
AFB, AK.

STATEMENT OF FACTS
On 28 March 2006, the applicant's request to change his records to show the
award of two MSM’s was considered and denied by the Board. For an
accounting of the facts and circumstances surrounding the applicant’s
request, and, the rationale of the earlier decision by the Board, see the
Record of Proceedings at Exhibit E.
On 21 February 2007, he submitted a request for reconsideration and offered
additional supporting evidence to support his request for an MSM upon
leaving Elmendorf AFB, AK. He is still trying to obtain other evidence to
support his request for award of a second MSM. To support this request
however, he has provided a personal statement and a letter from his former
supervisor at Elmendorf AFB.

THE BOARD CONCLUDES THAT:
After again reviewing this application and the evidence provided in support
of the appeal, we remain unpersuaded that his records should be corrected
by this Board to show that he was awarded the MSM. In support of his
request for reconsideration, applicant provided a statement from an
individual stating the applicant worked for him and that if it had been his
responsibility to write a medal recommendation for the applicant, it would
have been for an MSM. While the comments provided regarding the
applicant's accomplishments are commendable, we find it noteworthy that
this individual does not appear on any of the applicant's performance
reports written during the period of time in question as having been in his
supervisory chain. In his supervisory chain or not, it is apparent he was
not in a position to make the determination as to whether or not award of a
particular medal is warranted; or the type and level of such award.
Consequently, we do not believe it would be appropriate for us undermine
the discretionary authority of the award approving officials based on the
evidence presented. In the absence of persuasive evidence from the
appropriate responsible individuals and since the applicant has failed to
sustain his burden of proof that an error or injustice exists we conclude
that no basis exists warranting favorable consideration of his request.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of material error or injustice; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.

The IPCOT was never filed; therefore, the reason for his extension does not exist and should be canceled. His request was approved on 24 May 2005 and his date of separation was extended from 19 August 2006 to 19 January 2007. This is evidence enough the IPCOT was not approved and at that time (within 30 days) the applicant should have requested the 5-month extension be canceled.

Regarding the second MSM, DPPPR agrees with the commander’s assessment that the applicant would not receive a medal at all upon leaving Alaska. DPPPR’s complete evaluation is at Exhibit B. He contends his commander while stationed at Alaska literally had the MSM package completed when the applicant was presented with a Letter of Admonishment (LOA).
