APPLICANT REQUESTS THAT:

In the applicant’s request for reconsideration, she  requests  her  deceased
spouse be awarded the Purple Heart Medal  with  one  oak  leaf  cluster  (PH
1OLC).

STATEMENT OF FACTS:

In an application  to  the  Board  dated  26  October  2005,  the  applicant
requested her deceased spouse be awarded the Purple Heart Medal and  the  PH
1OLC.  On 11 May 2006, the Board considered  and  approved  the  applicant’s
request for award of the Purple Heart for wounds to his hands and  feet  due
to frostbite incurred on a forced march while being held as  a  Prisoner  of
War in Germany from 7 June 1944 to 29 April 1945; however, the Board  denied
the request for the PH 1OLC.  A complete copy of the Record  of  Proceedings
(ROP) is at Exhibit G.

In a letter to  the  Board  dated  21  July  2006,  the  applicant  requests
reconsideration.  She states her deceased husband is entitled to and  should
be awarded an oak leaf cluster  to  the  Purple  Heart  Medal  for  injuries
(knees, ankles and back) sustained when his aircraft crash landed on 7  June
1944 over France, which was caused by enemy ground fire (Exhibit H).

THE BOARD CONCLUDES THAT:

Sufficient  relevant  evidence  has  been  presented  to   demonstrate   the
existence of an error or injustice.  In further support of  the  applicant’s
request,  she  provided  what  we  believe  to  be  credible  evidence  that
indicates the former servicemember injuries were incurred when his  aircraft
was shot down in a raid over Europe on 7 June 1944.  In view of  the  above,
we believe the former servicemember’s records should be  corrected  to  show
he  was  awarded  the  PH  1OLC.   Accordingly,  we  recommend  the   former
servicemember’s records be corrected to the extent indicated below.

THE BOARD RECOMMENDS THAT:

The pertinent military records of the Department of the Air  Force  relating
to SERVICEMEMBER, be corrected to show that he was awarded the Purple  Heart
Medal, First Oak Leaf Cluster for injuries received  in  action  against  an
enemy of the United States during a mission over Europe, on 7 June 1944.

MEMORANDUM FOR THE CHIEF OF STAFF

      Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:

      The pertinent military records of the Department of the Air Force
relating to XXX, be corrected to show that he was awarded the Purple Heart
Medal, First Oak Leaf Cluster for injuries received in action against an
enemy of the United States during a mission over Europe, on 7 June 1944.
