APPLICANT REQUESTS THAT:

His records be corrected to reflect a satisfactory year for  retirement  for
the years ending 15 Jun 03, 15 Jun 04, and 15 Jun 06.

APPLICANT CONTENDS THAT:

He was under the impression that if he served the required  number  of  duty
days for a good year during summer breaks, that he would have earned a  good
year.  He just  discovered  the  significance  of  the  retention/retirement
(R/R) year, which is 16 Jun – 15 Jun for him.  Had he known, or  been  told,
that he had to serve duty days between 16 Jun and 15 Jun each year in  order
to gain a good year, he would have rearranged his  schedule  or  added  duty
days.  He lost good years in 16 Jun 02 – 15 Jun 03, 16 Jun 04 –  15  Jun  05
[Applicant actually had a satisfactory year for retirement 16 Jun  04  –  15
Jun 05; however, did not have a satisfactory year 16 Jun 03 –  15  Jun  04],
and 16 Jun 05 – 15 Jun 06 because  of  this  error.   This  error  is  quite
obvious in the last 2 years, as he fell one point short of a  good  year  in
both years.  When he checked his records, he  was  told  this  error  occurs
frequently and that program managers  should  inform  their  troops  of  R/R
dates

He just finished a 7-year seminary, was  ordained  in  May,  and  pinned  on
Captain on 10 Aug 06, as a Reserve Captain.  He served 10  years  on  active
duty.

STATEMENT OF FACTS:

Information extracted from the Military Personnel Data System indicates  the
applicant is currently serving as a Chaplain in the  Air  Force  Reserve  in
the grade of captain.  As  of  retirement  year  ending  15  Jun  06  he  is
credited with  12  years  and  14  days  satisfactory  Federal  service  for
retirement.

The rest of the pertinent facts of this case are addressed in the Air  Force
evaluation.

AIR FORCE EVALUATION:

HQ ARPC/DPP recommends  the  applicant’s  request  be  denied.   The  member
states he was  unaware  of  the  significance  of  the  R/R  year  but  this
information was specifically  provided  as  a  part  of  Chaplain  Candidate
orientation.

On 16 Jun 00, the member was appointed into the Air Force  Reserve  Chaplain
Candidate program.  The applicant states that he was  under  the  impression
that by serving the required number of duty days  for  a  good  year  during
summer breaks from school, he would have earned satisfactory service.

According to the Air Force Reserve Chaplain Service at Robins  AFB  Georgia,
the member received detailed information concerning the  Chaplain  Candidate
program.  A copy of that information was  reviewed,  and  the  criteria  for
establishing the R/R year, point credit and  participation  in  relationship
to the R/R year was covered and was  within  the  guidelines  of  Air  Force
Manual  (AFM)    36-8001,  Reserve  Personnel  Participation  and   Training
Procedures.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 22 Sep 06, a copy of the  Air  Force  evaluation  was  forwarded  to  the
applicant for review and comment within 30 days.   As  of  this  date,  this
office has received no response.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice.  After a thorough review  of  the  evidence
of record and applicant’s submission, the  majority  of  the  Board  is  not
persuaded  by  his  uncorroborated  assertion  he  was  not  aware  of   the
significance of his Retention/Retirement (R/R) year.  We note the Air  Force
has indicated  as  part  of  the  Chaplain  Candidate  program  members  are
provided information pertaining to the criteria  for  establishing  the  R/R
year, and point credit and participation in relationship to  the  R/R  year.
Therefore,  the  majority  of  the  Board  does  not  find   his   arguments
sufficiently persuasive to  override  the  rationale  provided  by  the  Air
Force.  Therefore, in the absence of evidence to the contrary, the  majority
of the Board finds no compelling basis  to  recommend  granting  the  relief
sought in this application.

RECOMMENDATION OF THE BOARD:

The majority of the panel finds insufficient evidence of error or  injustice
and recommends the application be denied.
