APPLICANT REQUESTS THAT:
He be granted a time-in-grade waiver to meet eligibility requirements to
test in the 06E7 promotion cycle.

APPLICANT CONTENDS THAT:
Since being granted the opportunity to continue serving in the Air Force
through the Air Force Return to Duty Program, he is currently serving as a
technical sergeant which is a testament of both the effectiveness of the
Air Force Return to Duty Program and his commitment to the Air Force and
its mission. Since his return to duty, he has made significant
contributions, worked a myriad of crew positions within the Information
Management Career Field and has earned two commendation medals, two wing
level quarterly awards for excellence in the Communications and Information
(C&I) career field and was nominated as a finalist for the annual C&I in
2000 and 2001. With his experience and a colorful past, he feels he could
offer a greater service by working in the capacity of a First Sergeant.
However, the only disqualifying factor is his current rank. Since he did
not meet the minimum eligibility requirements to test in the 2006E7
promotion cycle, he inquired at his MPF if any waiver existed. He was
informed that no provisions or specific guidelines existed in AFI 36-2502
or 36-2604. He would like his performance reports his total active service
and experience be considered and he be granted a waiver to test for the
2006E7 promotion cycle.
In support of his request, applicant provides a personal statement, copies
of his performance reports, awards, certificates and letters of
appreciation. His submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:
The Military Personnel Database (MilPDS) reflects the applicant’s Total
Active Federal Military Service Date as 14 June 1987. The applicant is
currently serving in the grade of technical sergeant (E-6) with a date of
rank (DOR) and an effective date of 1 July 2005. His current duty title is
NCOIC, Executive Support.

AIR FORCE EVALUATION:
AFPC/DPPPWB recommends the application be denied. DPPPWB states that based
on the applicant’s DOR to technical sergeant (1 Jul 05), he will not be
eligible for promotion to master sergeant until cycle 07E7. In accordance
with AFI 36-2502, minimum eligibility requirements for promotion to master
sergeant is a 7-skill level as of the Promotion Eligibility Cutoff Date, 24
months TIG, 8 years time-in-service, and a written recommendation by the
promotion authority. DPPPWB states that all members must “bide their time”
to mature, gain knowledge, attend PME, and develop leadership skills in
each rank before advancing to the next rank. The DPPPWB evaluation is at

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
Applicant states his work ethic is depicted in his EPRs and also
demonstrates his level of maturity and leadership skills. He asks that his
accomplishments since his misconduct and his 19 years of military
experience be considered and he be given the opportunity to test for the
06E7 cycle. Applicant’s letter, with attachment, is at Exhibit D.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was timely filed.
3. Insufficient relevant evidence has been presented to demonstrate the
existence of error or injustice. We noted the applicant’s statements
concerning the reasons why he should be granted a waiver to test for the
06E7 promotion cycle. The applicant’s accomplishments since his misconduct
are without dispute, stellar. However, the evidence provided does not
persuade us that granting the applicant a waiver to test for the 06E7
promotion cycle is appropriate. Rather, we believe that he should continue
to mature, gain knowledge and further develop his leadership skills and be
recommended by his promotion authority for promotion consideration to
master sergeant. Therefore, we agree with the opinion and recommendation
of the Air Force office of primary responsibility and adopt their rationale
as the basis for our conclusion that the applicant has not been the victim
of an error or injustice. In the absence of evidence to the contrary, we
find no basis to recommend granting the relief sought.

THE BOARD DETERMINES THAT:
The applicant be notified that the evidence presented did not demonstrate
the existence of probable material error or injustice; that the application
was denied without a personal appearance; and that the application will
only be reconsidered upon the submission of newly discovered relevant
evidence not considered with this application.
