APPLICANT REQUESTS THAT:
He be awarded Air Force Parachute Jump Wings.

APPLICANT CONTENDS THAT:
He was one of 10 Air Force officers first assigned to Vietnam in 1962. A
volunteer was needed to go to the Vietnamese Airborne Brigade who would
have to go through the Vietnamese Parachute Training School. He
volunteered, completed the training in October of 1962 and served as the
Air Force Air Liaison Officer to the Vietnamese Airborne Brigade.
In support of his request, applicant provided a personal statement, and
documents extracted from his military records. His complete submission,
with attachments, is at Exhibit A.

STATEMENT OF FACTS:
Applicant initially entered military service on 19 Aug 42. He was
progressively promoted to the grade of lieutenant colonel having assumed
that grade effective and with a date of rank of 22 Jun 70. He served in
the Republic of Vietnam from 7 Jul 62 through 20 Jul 63 and from 2 Aug 64
through 1 Aug 67. He retired from the Air Force on 31 Dec 73, having
served 31 Years, 4 months, and 12 days on active duty.

AIR FORCE EVALUATION:
USAF/XOOT recommends denial. XOOT states although he did perform combat
jumps and was awarded the Vietnamese Parachutist Badge with 4 bronze stars,
he was not assigned to an Air Force position requiring parachute duty. In
accordance with the governing regulation at the time, to qualify as an Air
Force Parachutist, personnel must: (1) Possess a Parachutist rating from
either the Army or Navy, or (2) have satisfactorily completed the Basic
Airborne Course at the Army Infantry Center, Ft. Benning GA, including at
least five actual jumps. Despite this, he frequently volunteered to
perform combat jumps to better coordinate air strikes against NVA threats.
His records also show he has been credited with providing invaluable
leadership and training to RVN forces and consistently provided allies with
an advanced tactical knowledge.
XOOT states the award of the Air Force Parachutist Badge would be contrary
to guidance. XOOT adds however, that its division has yet to review a
package more deserving than that of the applicant’s.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:
A copy of the Air Force evaluation was forwarded to the applicant on 6 Jan
06 for review and comment within 30 days. As of this date, this office has
received no response.

THE BOARD CONCLUDES THAT:
1. The applicant has exhausted all remedies provided by existing law or
regulations.
2. The application was not timely filed; however, it is in the interest of
justice to excuse the failure to timely file.
3. Sufficient relevant evidence has been presented to demonstrate the
existence of an injustice warranting corrective action. In this respect,
to be awarded Air Force Jump Wings, the governing regulation during the
time period in question required individuals to possess a Parachutist
rating from either the Army or Navy; or, have satisfactorily completed the
Basic Airborne Course at Ft. Benning, GA, with five actual jumps. Although
the applicant completed parachute training at a Vietnamese training school,
rather than at Ft. Benning, it appears that the instruction provided at
that location was oversaw by Army advisors from the 82nd and 101st Airborne
Divisions. In addition, the number of jumps completed by the applicant
exceeded the minimum number of actual jumps required for award of Jump
Wings. Accordingly, it is our opinion that as an exception to policy, we
believe that he has exceeded the minimum requirements and should be awarded
Air Force Parachutist Badge. Therefore, we recommend his records be
corrected as indicated below.

THE BOARD RECOMMENDS THAT:
The pertinent military records of the Department of the Air Force relating
to APPLICANT be corrected to show that on 23 December 1965, he was awarded
Air Force Jump Wings.

MEMORANDUM FOR THE CHIEF OF STAFF
Having received and considered the recommendation of the Air Force
Board for Correction of Military Records and under the authority of Section
1552, Title 10, United States Code (70A Stat 116), it is directed that:
The pertinent military records of the Department of the Air Force
relating to APPLICANT, be corrected to show that on 23 December 1965, he
was awarded Air Force Parachutist Badge.
