APPLICANT REQUESTS THAT:

The Joint Chiefs of  Staff  (JSC)  Identification  Badge  be  added  to  his
military records.

APPLICANT CONTENDS THAT:

The attached certificate showed that he had completed  six  months  of  duty
with the Joint Chiefs of Staff organization. He should be  entitled  to  the
award of the Joint Chiefs of Staff Identification Badge.

In support of his request, applicant provided his DD Form 214,  and  a  copy
of JCS Organization Certificate, dated 12 June  1955,  authorizing  him  the
Department of Defense Identification Badge and  the  Department  of  Defense
Lapel Button or Pin.

Applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

Applicant’s military records  were  destroyed  in  the  1973  fire  at  the
National Personnel Records Center.

The available records reveal that the applicant served on active duty  from
19 May 1953 through 18 May 1957. He received an honorable  discharge  after
completing four years of total active military service.

His medals, badges and ribbons when discharged, included the Air Force  Good
Conduct Medal, the National Defense Service Medal,  and  the  Department  of
Defense Identification Badge.

AIR FORCE EVALUATION:

AFPC/DPF recommends denial and states that the  AFI  36-2923,  Aeronautical,
Duty and Occupational Badges, identifies JCS/J1  as  the  OPR  for  the  JCS
Identification Badge.  This particular badge was created  and  approved  for
wear  on  5  April  1963.   The  badge  is  not  retroactive  for  personnel
identified as serving a JCS tour prior to 5 April 1963.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A complete copy of the Air Force evaluation was forwarded to  the  applicant
on 15 October 2004, for review and comment  within  30  days.   As  of  this
date, no response has been received by this office.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided  by  existing  law  or
regulations.

2.  The application was not timely filed; however, it is in the interest  of
justice to excuse the failure to timely file.

3.  Insufficient relevant evidence has been  presented  to  demonstrate  the
existence of error or injustice that would warrant approval.  As  stated  by
the AFPC/DPF, JCS/JI is the approving authority for the  award  of  the  JCS
Identification Badge and the Board is without the  authority  to  award  the
badge.  Furthermore,  it  appears  the   Joint   Chiefs   of   Staff   (JSC)
Identification Badge was created after the applicant’s  discharge  from  the
Air  Force  and  there  were  no  provisions  made  to  award   this   badge
retroactively. In view of the above, we find no basis to recommend  granting
the relief sought in this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of material error  or  injustice;  that  the  application  was
denied without a personal appearance; and that the application will only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
