APPLICANT REQUESTS THAT:

It appears he  wishes  to  be  reconsidered  for  a  position  vacancy  (PV)
promotion by a Special Review Board (SRB) for the Fiscal  Year  2005  (FY05)
Reserve of the Air Force (ResAF) Major PV Board.

APPLICANT CONTENDS THAT:

He has met all requirements for PV to major; he is currently  in  a  major’s
billet, and has completed over four years of time-in-grade (TIG).   Although
Professional Military Education (PME)  is  not  a  written  requirement  for
promotion, based on information released by  HQ AFRC,  several  selects  for
major had not completed PME.

Applicant’s complete submission, with attachments, is at Exhibit A.

STATEMENT OF FACTS:

The applicant is currently serving in the Air Force Reserve in the grade  of
captain effective and with a date of rank (DOR) of 30 September 1999.

The applicant was considered and not selected  for  promotion  by  the  FY05
Line and Health Professions Major Position  Vacancy  (PV)  Selection  Board,
which convened on 9 February 2004.

AIR FORCE EVALUATION:

ARPC/DPB indicated upon review of the applicant’s record, they found he  did
not complete  Squadron  Officer  School  (SOS),  the  appropriate  level  of
professional level of PME for promotion to major.  Completion of PME is  not
a “pass/fail” requirement and board members are  informed  of  this  by  the
Secretary  of  the  Air  Force  Memorandum  of  Instruction.   However,  the
statistics for this PV promotion board  showed  that  of  the  184  officers
considered for promotion, 92 percent of them  completed  PME.   Of  the  138
selected for promotion, all 138 completed PME.  No  officer  who  failed  to
complete PME was selected for PV promotion.  The  full  quota  (75  percent)
was used selecting these 138 officers for promotion.  The applicant has  not
alleged there was an error in his record, so they cannot  recommend  denying
or approving anything.  They found no error when they  reviewed  his  record
and therefore do not believe a  “second  look”  (special  board  or  special
selection board) is warranted.  If the applicant finds there  was  an  error
in  his  record  when  it  was  considered  by  the  FY05  Line  and  Health
Professions Major PV Selection Board, they can reevaluate his claim at  that
time.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

On 21 May 2004, a copy of the Air Force  evaluation  was  forwarded  to  the
applicant for review and response within 30  days.   As  of  this  date,  no
response has been received by this office.

THE BOARD CONCLUDES THAT:

1.    The applicant has exhausted all remedies provided by existing  law  or
regulations.

2.    The application was timely filed.

3.    Insufficient relevant evidence has been presented to  demonstrate  the
existence of an error or injustice.  The applicant appears to be  requesting
reconsideration by a Special Review Board  for  the  FY05  Line  and  Health
Professions Major Position Vacancy Board.  He indicates he has met  all  the
requirements for promotion to the grade  of  major  with  the  exception  of
completing his Professional Military Education  (PME).   He  indicates  that
completion  of  PME  is  not  a  requirement  for  promotion   and   several
individuals selected for promotion by the FY05 board did not  complete  PME.
Although it may not be a requirement  for  promotion  consideration,  it  is
noted that all the individuals who were selected for promotion by  the  FY05
board did complete PME.  While it cannot be determined that the lack of  PME
was the sole cause of his nonselection,  according  to  the  statistics  for
this particular board, it certainly appears that his chances  for  selection
would have been enhanced had  he  completed  Squadron  Officer  School.   We
would strongly encourage him to complete his PME before his  next  promotion
consideration.  In view of the foregoing, we find no  basis  upon  which  to
make a favorable recommendation on this application.

THE BOARD DETERMINES THAT:

The applicant be notified that the evidence presented  did  not  demonstrate
the existence of an error or injustice;  that  the  application  was  denied
without a personal  appearance;  and  that  the  application  will  only  be
reconsidered upon the submission of newly discovered relevant  evidence  not
considered with this application.
