APPLICANT REQUESTS THAT:

The following documents be included in his  officer  selection  record
(OSR) for the CY03B Major Central Selection Board:

        a.  Army Commendation Medal  (ACM),  First  Oak  Leaf  Cluster
(1OLC).

        b.  Air Force  Institute  of  Technology  (AFIT)  Supplemental
Training Report (TR)  for  his  participation  in  a  master’s  degree
program.

He be granted consideration for promotion to the  grade  of  major  by
Special Selection Board (SSB) for the CY03B  Major  Central  Selection
Board with the corrected record.

APPLICANT CONTENDS THAT:

Since information regarding his master’s degree was masked during  the
CY03B board, the missing supplemental training  report  was  the  only
document in his record showing his completion of  a  master’s  degree.
The report in his records indicated he had not  completed  his  thesis
and was a negative factor for the promotion board.  He took action  on
17 Nov 03 to get his missing ACM citation included  in  his  OSR.   He
turned the document into  his  military  personnel  flight  (MPF)  and
understood the document would be faxed out the same day.

STATEMENT OF FACTS:

The  applicant  entered  active  duty  on  11  Aug  95   after   being
commissioned through Officer Training School.  He is presently serving
in the grade  of  captain.   The  applicant  was  considered  and  not
selected for promotion to major by the CY03B (8 Dec 03) Major  Central
Selection Board.

AIR FORCE EVALUATION:

AFPC/DPPPE recommends denial of the applicant’s request to include the
AFIT TR in his OSR.  In accordance with AFI 36-2406, paragraph  6.2.2,
the applicant could have requested to have a TR filed in  his  record.
However, to be  included  in  his  OSR,  the  action  must  have  been
completed prior to the promotion board.   The  instruction  sheet  for
review of the pre-selection brief advises  that  only  the  bachelor’s
degree  information  will  be  reflected  and  any  advanced  degrees,
including AFIT sponsored, will be masked on the OPB.  Promotion  board
members are given instructions regarding exclusion of  information  on
advanced degrees from  the  Officer  Selection  Brief  (OSB)  and  are
cautioned not to give such information disproportionate  weight.   The
AFIT TR was not a necessary document to be included in the applicant’s
OSR for the CY03B Major Central Selection Board.

AFPC/DPPPO states that consideration for promotion  by  SSB  based  on
inclusion of the AFIT  TR  is  not  warranted  based  on  AFPC/DPPPE’s
recommendation.  Regarding his ACM (1OLC), they  determined  that  the
citation for the ACM (1OLC) was included in the OSR, but the  citation
for the basic award of the ACM was missing.  Although the  applicant’s
record was missing the basic citation, board members were  aware  that
he was awarded two ACMs since they were listed on his OSB.  AFPC/DPPPO
recommends  denial  of   the   applicant’s   request   for   promotion
consideration by SSB based on the missing ACM citation.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

Copies of the Air Force evaluations were forwarded to the applicant on
27 Aug 04 for review and comment within 30 days.  To date, a  response
has not been received.

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing  law
or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented  to  demonstrate
the  existence  of  error  or  injustice.   We  took  notice  of   the
applicant's complete submission in judging the  merits  of  the  case;
however, we agree with the opinions and  recommendations  of  the  Air
Force offices of primary responsibility and adopt their  rationale  as
the basis for our conclusion that  the  applicant  has  not  been  the
victim of an  error  or  injustice.   Therefore,  in  the  absence  of
evidence to the contrary, we find no  compelling  basis  to  recommend
granting the relief sought in this application.

THE BOARD DETERMINES THAT:

The  applicant  be  notified  that  the  evidence  presented  did  not
demonstrate the existence of material error  or  injustice;  that  the
application was denied without a personal  appearance;  and  that  the
application will only be reconsidered upon  the  submission  of  newly
discovered relevant evidence not considered with this application.
